The Ministry of Education and Training has just issued Circular 21/2025/TT-BGDDT regulating the regime of paying overtime wages for teachers in public educational institutions.
In particular, Article 6 of the Circular stipulates the payment of overtime wages for teachers who have worked for less than a school year.Specifically as follows:
1. Teachers with less than 1 school year of teaching time will receive overtime salary corresponding to actual working time.
2. The salary of 01 teaching period for teachers who have worked for less than one school year is determined as follows:

In which:
a) For teachers in preschool education institutions:
Coefficient of teaching periods/real working time = (Coefficient teaching hours/day) x (Coefficient of working days/week) x (Coefficient of actual teaching weeks corresponding to actual working time);
b) For teachers in general education institutions, continuing education institutions, university reserve schools, and specialized schools:
Coefficient of actual teaching hours/work time = (Average teaching hours in 01 week) x (The number of actual teaching weeks corresponds to actual working hours);
c) For teachers of other educational institutions:
Coefficient of teaching periods/real working time = [(Coefficient of teaching periods/school year) x (The number of actual teaching weeks corresponds to the actual working time) ]/ (Coefficient of teaching weeks in the school year);
d) The number of teaching weeks or teaching children according to regulations does not include the number of reserve weeks.
3. The total number of extra teaching periods in a school year for teachers as prescribed in this Article is determined as follows:
Number of extra teaching periods of teachers/school year = (Tuanum of teaching periods during actual work) - (Norm for teaching periods/real work time).
In which:
The total number of teaching periods during actual work includes: the number of periods taught during actual work; the number of teaching periods converted during actual work according to regulations (if any); the number of teaching periods added during actual work according to regulations (if any); the number of teaching periods reduced during actual work according to regulations (if any); the number of teaching periods included in the number of teaching periods sufficient during actual work according to regulations (if any).
For teachers assigned to teach part-time or inter-schools, the number of teaching periods during the actual working period is the total number of teaching periods during the actual working period at all educational institutions in which teachers participate in teaching.
4. The salary for 01 extra teaching period and the salary for extra teaching hours/school year for teachers as prescribed in Clause 1 of this Article are determined according to the provisions of Clause 2, Clause 3, Article 5 of this Circular.
5. In case of 3 or more days off in 01 week, that week will not be counted as the actual teaching week; in case of less than 03 days off in 01 week, that week will be counted as the actual teaching week.
