On July 25, the Department of Home Affairs of Dong Nai City conducted mediation of a labor dispute between Ms. N.T. T (born in 2005, residing in Tan Trieu ward, Dong Nai City) and Austgrow Vietnam International Group Co., Ltd. (Thanh Phu - Thien Tan Industrial Cluster, Ong Huong hamlet, Trang Dai ward, Dong Nai City).
According to Ms. N.T. T's complaint, she was recruited to work at Austgrow Vietnam International Group Co., Ltd. under a labor contract. During the working process, the company deducted her salary monthly to participate in compulsory social insurance according to regulations. In March 2026, she retired to enjoy maternity benefits. After that, she submitted complete dossiers requesting maternity benefits to the company according to regulations.
However, up to now, the company has not yet prepared a dossier to send to the social insurance agency to resolve maternity benefits for her. Through investigation, she learned that the company is owing social insurance contributions, so it has not been certified by the social insurance agency for social insurance participation and has not resolved maternity benefits.
Therefore, Ms. T requested the company to fully fulfill its social insurance obligations and complete procedures to confirm the social insurance participation process; at the same time, prepare documents and carry out procedures for the social insurance agency to resolve and pay maternity benefits for her according to regulations.
Commitment to resolve maternity benefits before September 15th.
According to the reconciliation record, the company confirmed that it still owes social insurance contributions, so it has not completed the certification of social insurance participation process for employees. The company requested employees to create conditions for the company to extend the time to fulfill social insurance obligations until before September 15, 2026; Austgrow Vietnam International Group Co., Ltd. also committed to coordinate with the social insurance agency to complete the dossier to resolve maternity benefits for Ms. T. before September 15, 2026.
Ms. T. has had hearing and speech disabilities since childhood. In 2025, Ms. T married Mr. T.M. C (born in 2000, also with hearing and speech disabilities) and had 1 child. Both husband and wife work as workers at Austgrow Vietnam Group Co., Ltd.
According to the list of units that are late in paying social insurance, health insurance, and unemployment insurance, as of June 30, publicly announced by Dong Nai City Social Insurance, Austgrow Vietnam International Group Co., Ltd. has 244 employees, owing 7 months of insurance with a late payment amount of more than 4 billion VND, including: social insurance, health insurance, unemployment insurance, occupational accident insurance.
Mr. Vu Ngoc Ha - a labor law expert in Dong Nai City - said that businesses that have been slow to pay social insurance in the past have caused great difficulties for workers, causing workers' rights to be "suspended" such as: not being able to retire, not being able to settle sickness and maternity benefits, workers' rights are disadvantaged. When workers work in other companies, their rights are also affected.
According to the Dong Nai City Labor Federation, reports from the Dong Nai City Social Insurance show that as of May 31, 2026, there are 180 enterprises in the city (with 20 or more employees) that are late in paying social insurance, health insurance, and unemployment insurance for 3 months or more with a total debt (with interest) of more than 196 billion VND.
