According to Clause 4, Article 3 of Decree 219/2025/ND-CP (effective from August 7, 2025), documents proving that foreign workers are technical workers are one of the following documents:
a) Certificate, certificate or certificate proving at least 1 year of training and a document confirming the employer's experience working abroad in the number of years of that technical worker.
In case foreign workers who have worked in Vietnam are allowed to use a work permit or a certificate that is not subject to a issued work permit to replace the document proving work experience in the field suitable for the job position that the foreign worker plans to work in Vietnam;
b) Confirmation document of the employer abroad on the number of years of working experience of that technical worker.
In case foreign workers who have worked in Vietnam are allowed to use a work permit or a confirmation letter that is not subject to being granted a work permit that has been issued to replace the documents proving work experience in the field suitable for the job position that the foreign workers plan to work in Vietnam.
According to the provisions of Decree 219/2025/ND-CP, technical workers fall into one of the following cases: a) Having been trained for at least 1 year and having at least 2 years of experience suitable for the job position that foreign workers are expected to work in Vietnam; b) Having at least 3 years of experience suitable for the job position that foreign workers are expected to work in Vietnam.
