According to Article 3 of Decree 219/2025/ND-CP (effective from August 7, 2025), the job position of foreign workers working in Vietnam is regulated as follows:
- The manager is the person managing the enterprise as prescribed in Clause 24, Article 4 of the Law on Enterprises or the head or deputy head of the head of the agency or organization as prescribed by law.
- Executive directors in one of the following cases:
+ Head of the branch, representative office or business location of the enterprise;
+ The head and direct operator of an agency, organization, or enterprise in one field and has at least 3 years of experience in the field suitable for the job position that foreign workers are expected to work in Vietnam.
- Experts in one of the following cases:
+ Have a university degree or higher or equivalent and have at least 2 years of working experience suitable for the job position that foreign workers are expected to work in Vietnam;
+ Have a university degree or higher in a specialized field and have at least 1 year of experience suitable for the job position that foreign workers are expected to work in Vietnam for experts working in the fields of finance, science, technology, innovation, national digital transformation or priority areas for socio-economic development determined by ministries, ministerial-level agencies, and provincial People's Committees or according to the cooperation agreement of the Vietnamese Government.
- Technical labor in one of the following cases:
+ Having received at least 1 year of training and at least 2 years of experience suitable for the job position that foreign workers are expected to work in Vietnam.
+ Have at least 3 years of working experience suitable for the job position that the foreign worker plans to work in Vietnam.
