Youme Law Firm LLC said that, based on Article 13 of the 2008 Law on Cadres and Civil Servants, it stipulates:
Rights of cadres and civil servants to rest
Officials and civil servants are entitled to annual leave, holidays, and leave to handle their own work according to the provisions of the law on labor. In case, due to task requirements, cadres and civil servants do not use or do not use all the annual leave days, in addition to salary, they will also be paid an additional amount equal to salary for the days not taken.
And Clause 1, Article 13 of the 2010 Civil Servants Law stipulates:
Civil servants' rights to rest
1. Have annual leave, holidays, and personal leave according to the provisions of the law on labor. Due to work requirements, civil servants who do not use or do not use all of their annual days off will be paid a sum of money for the days off.

Referring to Article 112 of the 2019 Labor Code, the Tet holiday schedule is stipulated as follows:
Holidays, Tet
1. Employees are entitled to take a day off and receive full pay during the following holidays and Tet:
a) New Year's Day: 1 day (January);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30);
d) International Labor Day: 1 day (May 1);
d) National Day: 2 days (September 2 and 1 day before or after);
e) Hung Vuong's Commemoration Day: 1 day (10th of the third lunar month).
2. Foreign workers working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are also entitled to an additional day off for the traditional New Year and a day off for their country's National Day.
3. Every year, based on actual conditions, the Prime Minister decides specifically on the day off specified in Point b and Point d, Clause 1 of this Article.
Accordingly, the 2026 Tet holiday schedule according to the 2019 Labor Code for employees and civil servants is divided into 2 Tet holidays as follows:
(1) New Year's holiday schedule schedule: 1 day (January 1, 2026)
(2) Lunar New Year holiday schedule: 5 days
Thus, according to the 2026 Lunar New Year holiday schedule according to the 2019 Labor Code for employees and civil servants, including the Lunar calendar and the New Year calendar, the number of days off will be up to 6 days.
Note: for the holidays of the 2026 Lunar New Year holiday, every year, based on actual conditions, the Prime Minister will make specific decisions.
