Official Dispatch No. 666/SNV-XDCQ states that Official Dispatch No. 03/CV-BCĐ provides guidance: Officials, civil servants, public employees, and laborers receiving salaries from the state budget when assigned to work in new administrative units will continue to receive salaries according to ranks, divisions and current salary allowances for 6 months; then implement according to new regulations of the Government.
While waiting for a new document from the Government guiding the regime of allowances and salary regimes for cadres, civil servants, and public employees under the commune-level People's Committee, the implementation of payment of salaries, allowances and contributions according to the regime (social insurance, unemployment insurance, health insurance) will face difficulties, especially in January 2026. To ensure compliance with regulations and avoid cases of incorrect payments that must be recovered from subjects, the Department of Home Affairs requests the commune and ward People's Committees to implement payment of salary regimes for cadres, civil servants, and public employees of the commune-level People's Committee as follows:
For cadres, civil servants, and public employees of the Commune-level People's Committee when assigned to work in new administrative units (July 1, 2025), salaries and position allowances (if any) will be preserved and maintained until December 31, 2025, which is 6 months from the date of the document on assignment according to the provisions of Article 11 of Resolution 76/2025/QH15 and Official Dispatch No. 03/CV-BCĐ dated April 15, 2025 of the Steering Committee: No further implementation of preserving and maintaining the regime and policies on salaries and position allowances (if any) from January 1, 2026.
Continue to implement the payment of salary coefficients according to ranks, departments enjoying, and public service allowances (for cadres, civil servants), and public employees of commune-level People's Committees according to current legal regulations.
Implement payment of allowances as follows:
Leadership position allowance:
Implement payment from January 1, 2026 of leadership position allowances for the Chairman of the People's Committee; Vice Chairman of the People's Committee; Head of Professional Department under the People's Committee and equivalent; Deputy Head of Professional Department under the People's Committee and equivalent according to the provisions of Decree No. 07/2026/ND-CP dated January 10, 2026 of the Government on amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary regime for cadres, civil servants, public employees and armed forces amended and supplemented by Decree No. 76/2009/ND-CP, Decree No. 14/2012/ND-CP, Decree No. 17/2013/ND-CP and Decree No. 117/2016/ND-CP.
Regional allowance:
Payment is made from January 1, 2026 and applied according to the levels specified in the appendix attached to Circular 23/2025/TT-BNV dated December 24, 2025 of the Ministry of Home Affairs on amending and supplementing a number of contents of Joint Circular No. 11/2005/TTLT-BNV-BLĐTBXH - BTC-UBDT dated January 5, 2005 of the Minister of Home Affairs, Minister of Labor - Invalids and Social Affairs, Minister of Finance, Chairman of the Committee for Ethnic Minorities guiding the implementation of regional allowance regimes.
Public service allowance:
Implementing the payment of public service allowances from January 1, 2026 for public employees recruited into civil servants by competent authorities when implementing two-level local government according to current legal regulations. For civil servants transferred to public employees who do not implement the payment of public service allowances from January 1, 2026.
