Article 91 of the Law on Social Insurance 2024 (effective from July 1, 2025) stipulates the settlement of death benefits for participants in compulsory social insurance as follows:
- Within 90 days from the date the person is reserving the social insurance payment period, the person is receiving or temporarily stopping receiving monthly pension, occupational accident and disease allowance, if he/she dies, the relatives or organizations or individuals who are in charge of the funeral shall submit the dossier prescribed in Article 90 of the Law on Social Insurance 2024 to the social insurance agency.
- Within 90 days from the date the employee participating in compulsory social insurance dies, the relatives or organizations or individuals who are in charge of the funeral shall submit the dossier prescribed in Article 90 of the Law on Social Insurance 2024 to the employer.
Within 30 days from the date of receiving the complete dossier from the employee's relatives, the employer is responsible for submitting the dossier to the social insurance agency.
- Within 10 working days from the date of receiving the complete dossier as prescribed, the social insurance agency is responsible for handling it; in case of failure to resolve, it must respond in writing and state the reason.
