Article 16 of Decree No. 219/2025/ND-CP of the Government regulating foreign workers working in Vietnam clearly states the procedure for extending the certificate for foreign workers working in Vietnam.
Specifically:
1. At least 10 days but not more than 45 days before the expiration date of the confirmation certificate not subject to a work permit, the employer shall submit a request for an extension of the confirmation certificate not subject to a work permit directly or through the public postal service or through the hiring of a service of a business or individual or through authorization to the Public Administration Service Center in the locality where the foreign worker is working.
2. The local Public Administration Service Center transfers the dossier according to the provisions of law on implementing administrative procedures according to the one-stop, one-stop mechanism at the one-stop department and the National Public Service Portal to the competent authority to extend the confirmation certificate not subject to issuance of a labor license.
3. Within 5 working days from the date of receiving a complete application for an extension of a certificate not subject to a work permit, the competent authority shall extend the certificate of confirmation not subject to a work permit for foreign workers.
In case the confirmation certificate is not granted a labor license, there must be a written response and a clear reason.
