From July 1, 2025, when the 2024 Social Insurance Law officially takes effect, employees who work part-time but have a labor contract of 1 month or more and a salary not lower than the minimum wage as the basis for compulsory social insurance contributions will be eligible to participate in compulsory social insurance.
According to Clause 1, Article 2 of the Social Insurance Law 2024, part-time employees, as long as they meet the conditions on contracts and wages, will enjoy full compulsory social insurance benefits, including sick leave.
Specifically, according to Article 42 of the Social Insurance Law 2024, employees will receive sick leave benefits when they quit their jobs for treatment in the following cases:
- Regular medical conditions, not occupational diseases;
- Having an accident outside the scope of a work accident;
- Having an accident on a reasonable route from a place of residence to a workplace and vice versa;
- Treatment and recovery from occupational accidents or recurring occupational diseases;
- Improves, removes or transplants tissues and organs of the human body;
- Caring for a sick child under 7 years old.
Thus, Ms. Vy An and part-time workers who have signed valid contracts and paid social insurance in accordance with regulations will enjoy the same sick leave as full-time workers.
