Representative of the Ministry of Culture, Sports and Tourism responded to the case of Dam Vinh Hung.

On the afternoon of November 15, regarding the singer Dam Vinh Hung performing in the US while serving the 9-month suspension of performing activities, Mr. Nguyen Danh Hoang Viet - Chief of Office of the Ministry of Culture, Sports and Tourism - said: "We have received the information and are in the process of processing it. In the next 2-3 days, the Ministry of Culture, Sports and Tourism will have a response on this incident."

Previously, a Facebook account posted photos and clips of singer Dam Vinh Hung performing at an event held in the US.

Then, the poster of a concert in the US at the end of November 2024 again featured Dam Vinh Hung's image. Since then, public opinion has been divided on whether the male singer's performance in the US violated the decision to ban him from performing 9 months earlier.

On November 14, responding to this issue, a representative of the Department of Culture and Sports of Ho Chi Minh City said that they had received information about Dam Vinh Hung performing abroad.

According to the representative of the Department of Culture and Sports of Ho Chi Minh City, based on Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government stipulating administrative sanctions in the fields of culture and advertising; Based on Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees stipulating administrative sanctions in the fields of tourism; sports; copyright, related rights; culture and advertising; Pursuant to Decree No. 128/2022/ND-CP dated December 30, 2022 of the Government amending and supplementing a number of articles of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government regulating administrative sanctions in the fields of culture and advertising, which has been amended and supplemented by Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees regulating administrative sanctions in the fields of tourism; sports; copyright, related rights; culture and advertising; at Point a and Point b, Clause 1, Article 2 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government, the subjects of application are:

Vietnamese organizations and individuals commit administrative violations in the fields of culture and advertising in Vietnam and abroad.

Foreign organizations and individuals committing administrative violations in the fields of culture and advertising in Vietnam.

In particular, Decree No. 38/2021/ND-CP stipulates the handling of organizations and individuals using performers during the period of suspension of performance activities by competent state agencies to organize art performances as prescribed in Clause 4, Article 11 of Decree No. 38/2021/ND-CP. There are no regulations on handling performers during the period of suspension of performance activities by competent state agencies.

"Therefore, Mr. Huynh Minh Hung (singer Dam Vinh Hung) was invited by foreign organizations and individuals to sing abroad (not in Vietnam's territory), so there are no sanctions for this case," said a representative of the Department of Culture and Sports of Ho Chi Minh City.

On July 10, 2024, Ms. Tran Thi Dieu Thuy - Vice Chairwoman of the Ho Chi Minh City People's Committee - signed a decision to punish singer Dam Vinh Hung for "performing art using costumes, words, sounds, images, movements, means of expression, performance forms and behaviors contrary to national traditions and customs; negatively affecting morality, public health and social psychology".

In addition, Dam Vinh Hung was also subject to an additional penalty of 9-month suspension from performing activities as prescribed in Point b, Clause 9, Article 11 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government.
