Recently, a Facebook account posted photos and clips of singer Dam Vinh Hung performing at an event held in the US.
Then, the poster of a concert taking place in the US at the end of November 2024 again featured Dam Vinh Hung's image. Since then, public opinion has had many conflicting opinions about whether the male singer's performance in the US violated the decision to ban him from performing 9 months earlier?
Responding to this issue, a representative of the Department of Culture and Sports of Ho Chi Minh City said: "Pursuant to Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government stipulating sanctions for administrative violations in the fields of culture and advertising; Pursuant to Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees stipulating sanctions for administrative violations in the fields of tourism; sports; copyright, related rights; culture and advertising; Pursuant to Decree No. 128/2022/ND-CP dated December 30, 2022 of the Government amending and supplementing a number of articles of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government stipulating sanctions for administrative violations in the fields of culture and advertising, which has been amended and supplemented by Decree No. Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees regulating administrative sanctions in the fields of tourism; sports; copyright, related rights; culture and advertising; at Point a and Point b, Clause 1, Article 2 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government stipulates that the subjects of application are:
Vietnamese organizations and individuals commit administrative violations in the fields of culture and advertising in Vietnam and abroad.
Foreign organizations and individuals committing administrative violations in the fields of culture and advertising in Vietnam.
And Decree No. 38/2021/ND-CP has provisions on handling organizations and individuals who use performers during the period of suspension of performance activities by competent state agencies to organize art performances as prescribed in Clause 4, Article 11 of Decree No. 38/2021/ND-CP. There are no provisions on handling performers during the period of suspension of performance activities by competent state agencies.
Therefore, Mr. Huynh Minh Hung (singer Dam Vinh Hung) was invited by foreign organizations and individuals to sing abroad (not in Vietnam's territory), so there are no sanctions for this case.
On July 10, 2024, Ms. Tran Thi Dieu Thuy - Vice Chairwoman of the Ho Chi Minh City People's Committee - signed a decision to punish singer Dam Vinh Hung for "performing art using costumes, words, sounds, images, movements, means of expression, performance forms and behaviors contrary to national traditions and customs; negatively affecting morality, public health and social psychology".
In addition, Dam Vinh Hung was also subject to an additional penalty of 9-month suspension from performing activities as prescribed in Point b, Clause 9, Article 11 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government.
The time limit is calculated from the time singer Dam Vinh Hung receives the decision.
Previously, a representative of the Department of Culture and Sports of Ho Chi Minh City said that they had proposed that the competent authority handle the case of singer Dam Vinh Hung wearing a "strange" badge according to legal regulations.
The Department of Culture and Sports of Ho Chi Minh City stated that the "strange" badge on Dam Vinh Hung's shirt, which the male singer performed at the music night "Ngay em den sao troi", taking place on May 4, 2024, was inappropriate because it could easily be associated with sensitive issues related to politics, causing offense and creating bad public opinion. Especially at that time, when the whole country was preparing to celebrate important political events, the 49th anniversary of the Liberation of the South, the reunification of the country; the 70th anniversary of the Dien Bien Phu victory.
