Previously, in the first-instance judgment in the case of inheritance dispute of the late artist Vu Linh (real name Vo Van Ngoan), the People's Court of Ho Chi Minh City determined that Ms. Vo Thi Hong Loan was the legal adopted daughter of the late artist and was the first and only heir at the time of opening inheritance.
Accordingly, the court did not accept the plaintiff's request, Ms. Vo Thi Hong Nhung, to determine that she and Mr. Vo Van Nhieu belong to the line of inheritance to enjoy the entire inheritance of the late artist. At the same time, the requests to cancel the declaration of inheritance, cancel the transfer of property to Ms. Hong Loan and the request to return the house and land were also not accepted.
The judgment determined that the heritage left by the late artist Vu Linh included three main assets: a house and land use rights at No. 5 Doan Thi Diem, Ho Chi Minh City; land use rights of a land plot of 3,007 m2 in Ho Chi Minh City, and a Toyota car.
These are all identified as assets owned by Mr. Vo Van Ngoan before his death and as inheritance left to the heir according to the provisions of law.
Although not recognized as the heir to this heritage, Ms. Vo Thi Hong Nhung was recognized by the court for her contributions in managing, preserving, and creating the assets of the late artist. The Trial Panel determined that Ms. Nhung's contributions were equivalent to 15% of the total value of heritage at the time of judgment enforcement.
This means that Ms. Hong Nhung is not allowed to divide inheritance in rows, but receives a sum of money equivalent to 15% of the total value of the entire inheritance. After the judgment enforcement agency appraises the assets and announces the results, Ms. Hong Loan is obliged to pay Ms. Hong Nhung the corresponding amount of money for this contribution.
The remaining value, equivalent to 85% of the heritage block, belongs to the ownership and use of Ms. Vo Thi Hong Loan as the sole heir of the late artist Vu Linh.
After completing the obligation to pay the effort for Ms. Hong Nhung, Ms. Hong Loan has full ownership, use and carry out relevant legal procedures for the house at No. 5 Doan Thi Diem, land plot 3,007 m2 in Ho Chi Minh City and the Toyota car belonging to the late artist's inheritance.
