The Ministry of Education and Training is seeking opinions on the draft Decree of the Government regulating penalties for administrative violations in the field of education. The new Decree will replace the current regulations in Decree No. 04/2021, Decree No. 127/2021 and Decree No. 88/2022.
According to the Ministry of Education and Training, the development of the decree aims to institutionalize policies on arranging and streamlining the apparatus, perfecting the legal system, enhancing strictness and transparency in handling violations, and at the same time meeting practical requirements when implementing the two-level local government model.
Notably, in Article 19 of the draft, the Ministry of Education and Training proposes regulations on penalties for violations in enrollment in general education and educational institutions implementing the general education program.
Specifically, acts of enrolling students who are not the right subjects according to regulations; refusing to admit students who are eligible for admission; discriminating in enrollment in any form contrary to regulations; or forcing students to transfer schools, not admitting students contrary to regulations will be fined from 10-20 million VND.
For acts of forging documents or using fake documents for enrollment, the draft proposes a penalty of 20-30 million VND.
In addition to monetary fines, the draft also stipulates remedial measures.
Accordingly, violating educational institutions must receive learners in accordance with the law for cases of refusal of acceptance contrary to regulations; cancel the illegal enrollment results if using fake dossiers; and at the same time ensure full legitimate rights and interests of learners in accordance with the law.
According to the Ministry of Education and Training, the addition of these sanctions aims to improve discipline in enrollment work, ensure students' learning rights, and contribute to building a fair and transparent educational environment.
