Ms. Ngo Quynh Thanh is a preschool teacher, working and starting to pay compulsory social insurance from July 1, 2018. On September 1, 2019, Ms. Thanh was admitted to a public preschool.
During her working time, Ms. Thanh took maternity leave twice (the first time from December 1, 2021 to May 31, 2022, the second time from December 1, 2023 to May 31, 2024).
Ms. Thanh asked: "Is the time I take on maternity leave as prescribed counted towards the time I am entitled to receive seniority allowance for teachers? In my case, from when will the time I am entitled to receive seniority allowance for teachers be calculated?"
Regarding Ms. Thanh's question, the Ministry of Education and Training responded on the Government Electronic Information Portal as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2020/ND-CP dated August 1, 2020 of the Government. Accordingly, the subjects of application are teachers who are teaching and educating in public educational institutions. Clause 2, Article 3 of this Decree stipulates that the period of time not counted for seniority allowance for teachers includes sick leave and maternity leave exceeding the time limit prescribed by the law on social insurance.
Ms. Ngo Quynh Thanh was recruited as a civil servant at a public kindergarten on September 1, 2019, but she started paying compulsory social insurance on July 1, 2018. Therefore, from the date of participating in teaching and education with compulsory social insurance until 5 years (60 months), excluding the probationary period, she is eligible for seniority allowance equal to 5% of her current salary plus leadership position allowance and seniority allowance exceeding the framework (if any). From the sixth year onwards, each year (12 months) will be calculated with an additional 1%.
