The Ministry of Education and Training has just announced the draft Law on Teachers (3rd time) to collect opinions before submitting it to the National Assembly for comments at the session next October.
In the draft Law on Teachers, the Ministry of Education and Training proposed that teachers who were recruited and working in educational institutions before the effective date of this Law will be granted a license to practice teaching.
Teachers will have their teaching license revoked in the following cases:
- Teachers whose evaluation results show that they have not completed their tasks for 2 (two) consecutive years;
- Teachers do not meet the conditions for renewal of teaching license;
- Teachers who violate discipline may be forced to quit or be fired;
- Freelance teachers who take advantage of educational activities to propagate contents that are contrary to the Party's guidelines and viewpoints, the State's policies and laws, and contrary to good customs and traditions; propagate hostile policies, causing division in the great national unity bloc; shall be prosecuted for criminal liability for crimes against national security, crimes against human life, health, dignity and honor according to the provisions of the Penal Code;
- Application for a practice license is not in accordance with regulations.
In Article 22 of the draft Law on Teachers, the Ministry of Education and Training also proposed the authority to grant, extend, and revoke teaching practice licenses as follows:
The Ministry of Education and Training, the Ministry of Labour, War invalids and Social Affairs, within the scope of their assigned tasks and powers, shall grant or delegate to qualified higher education institutions the license to practice teaching for lecturers, pre-university teachers and those wishing to practice teaching in higher education institutions and colleges.
The Department of Education and Training and the Department of Education and Training grant teaching practice licenses to teachers of educational institutions under their management authority and to those who wish to practice teaching in preschool, general education, and continuing education institutions.
The Department of Labor, War Invalids and Social Affairs and the Department of Labor, War Invalids and Social Affairs grant teaching practice licenses to teachers of educational institutions under their management authority and to those who wish to practice teaching in vocational education institutions.
The competent authority has the authority to record additional information, extend, reissue, and revoke the teaching license.
According to the Ministry of Education and Training, teaching licenses are intended to facilitate teachers' recruitment and are the basis for evaluating and adjusting teacher training programs.
Previously, in the Draft Law on Teachers (2nd time), the Ministry of Education and Training expected that each teacher would have a "Certificate of Practice for Teachers". After that, this certificate received many mixed opinions, many teachers worried that it would create additional procedures and "sub-licenses".
In the draft Law on Teachers (3rd time) just announced, after receiving comments, the Ministry of Education and Training plans to use "practice license" instead of "practice certificate".
