On July 20, information from the Department of Education and Training of Ha Tinh province said that the unit is seeking comments on the draft Regulation on transferring and reassigning teachers and teachers holding management positions at public educational institutions in the province.
The draft regulation applies to teachers at preschool, general education, continuing education and specialized public schools; and at the same time specifies the principles, conditions, time limits, authority, regimes, policies and procedures for transfer and relocation.
According to the draft, the transfer and reassignment must be carried out in accordance with authority, subjects, and procedures; ensuring publicity, transparency, objectivity, democracy and regimes and policies for teachers.
The mobilization aims to balance the staff between educational institutions, localities and departments; limit the situation of local teacher surplus and shortage, thereby ensuring students' learning rights and the quality of education.
In case necessary to ensure educational activities, competent authorities can carry out the transfer regardless of the teacher's wishes. Teachers subject to transfer are responsible for complying with the decisions of competent authorities.
The draft stipulates that teachers subject to transfer must be no more than 52 years old for women, no more than 54 years old for men and have been recruited and arranged into the Education sector for at least 3 years. The minimum transfer period is 3 years.
The mobilization is carried out from educational institutions with higher teacher ratios to places with lower ratios; from units with surplus teachers by subject to units lacking teachers or from places lacking little to places lacking a lot.
Voluntary teachers will be considered first. Next are those who have not worked in difficult areas, have not worked for 36 months in difficult areas or have never performed mobilization or assignment tasks.
In case teachers teach the same subject and have equivalent conditions, the draft proposes considering transferring male teachers first, female teachers later; if of the same sex, transferring younger people.
Teachers after completing the mobilization period and being assessed from a good completion of tasks or higher will be arranged to return to the old unit. In case of wishing to transfer to another educational institution, it will be considered if that place still has a suitable job position.
The draft also stipulates that no transfer is carried out for teachers who are being considered or disciplined; who are being inspected, investigated, prosecuted, or tried; who are being treated for serious illnesses; who are studying for a long time or who are assigned.
Female teachers who are pregnant, on maternity leave, or raising children under 36 months old are also subject to non-transfer. This regulation is applied similarly to male teachers who are directly raising children under 36 months old in some special cases.
For transfer, teachers must have at least 3 years of service from the date of recruitment, except for cases of voluntary transfer to ethnic minority areas, mountainous areas, border areas or areas with particularly difficult socio-economic conditions.
The transfer is expected to be carried out after the end of the first semester or during summer vacation, before the opening day of the new school year. Special cases will be considered by the Chairman of the Commune People's Committee or the Director of the Department of Education and Training according to their authority.
Leaders of the Ha Tinh Department of Education and Training said that the unit is organizing a widespread consultation, absorbing comments to continue to complete the draft and submit it to the Provincial People's Committee for consideration and decision.
