To ensure correct legal basis and practical basis, the Department of Education and Training of Quang Ninh province recommends that schools with high schools, the Provincial Vocational and Continuing Education Center, vocational education and continuing education centers participate and give comments on the above draft.
The content of the comments must be sent to the Department of Education and Training before March 31, 2025 for timely acceptance, completion, sent to the Department of Justice for appraisal and reporting to the People's Committee of Quang Ninh province according to regulations.
According to the draft, the Department of Finance is responsible for guiding and granting business registration certificates to organizations or individuals organizing extracurricular activities that collect money from students in accordance with the provisions of law. Organize and coordinate the inspection of the issuance of business registration certificates to additional teaching institutions by district-level People's Committees. Advising the Provincial People's Committee to arrange a budget to support extra teaching and learning for public educational institutions.
Preside over and coordinate with the Department of Education and Training to guide the management and use of funding for organizing extra teaching and learning; inspect the implementation of financial regulations in the management and use of funding for extra teaching and learning. Publicly and in writing to the Department of Education and Training and the People's Committees at the district level are required to register to do business in additional teaching facilities in June and December every year.
District People's Committees guide and issue business registration certificates to organizations and individuals organizing extracurricular activities to collect money from students in accordance with the provisions of law and regulations on decentralization. Public the list of legal tutoring institutions on the local website and update periodically every 6 months.
Coordinate with relevant agencies to allocate state budget resources for extra teaching and learning activities in public schools under their management. Organize inspections of extra teaching and learning activities in districts, towns and cities to handle according to authority or recommend to competent authorities to handle violations.
Extra-curricular institutions are responsible for developing teaching plans in accordance with the educational programs issued by the Ministry of Education and Training. The tutoring facility licensed to operate in accordance with the provisions of law is responsible for reporting to the People's Committee of the commune where the tutoring facility is located when it comes into operation or temporarily suspends or stops operations for updating and making public; refunding the money previously collected from the tutors who have not yet organized tutoring; fully paying the costs to the tutors and related organizations and individuals.
Encourage extra-curricular teaching institutions to exempt or reduce extra-curricular tuition fees for students who are children of policy families or families in difficult circumstances; participate in contributing to excellent student development activities, learning promotion movements, and investment in local education.
Regarding the fee for teaching and learning outside of school, it is agreed upon between parents and students and the extra-curricular institution. The collection, management and use of tuition fees by extra-curricular institutions are in accordance with the provisions of law.
After the Ministry of Education and Training's Circular No. 29/2024/TT-BGDDT was issued, in Quang Ninh, business registration in the education sector increased dramatically.
In Ha Long City alone, from the beginning of January 2025 to now, there have been over 600 business registration applications in the education sector.
