Each school is not allowed to have more than 2 deputy directors
According to point c, clause 2, Article 6 of Decree 120/2020/NĐ-CP, which took effect on 1.12.2020, the regulation on the number of deputy directors of the head of a public non-business unit is as follows: “For public non-business units that are self-financed for part of their regular expenditures, public non-business units that are guaranteed by the state budget for their regular expenditures, the number of deputy directors for public non-business units under the People's Committee of a district, ward, town, city under a province, or city under the Central Government shall not exceed 2”.
At the same time, according to Circular 19/2023/TT-BGDĐT and 20/2023/TT-BGDĐT guiding the position of work, the structure of cadres according to professional titles and the number of employees in public education institutions, which took effect on 16.12.2023, the regulation on the number of deputy directors is as follows:
“The number of deputy directors shall be implemented in accordance with the regulation on the number of deputy directors at Decree No. 120/2020/NĐ-CP dated 7 October 2020 of the Government on the establishment, reorganization, and dissolution of public non-business units”.
Therefore, at present, preschool and general education schools, regardless of the number of teachers, the number of classes, the number of school branches, etc., all have a maximum of not more than 2 deputy directors.
New regulations on the appointment of deputy directors
According to Decree 83/2024/NĐ-CP amending Decree 120/2020/NĐ-CP on the establishment, reorganization, and dissolution of public non-business units, the content is as follows:
For public non-business units that are self-financed for part of their regular expenditures, public non-business units that are guaranteed by the state budget for their regular expenditures, the number of deputy directors for units under the organizational structure of a ministry, a ministerial-level agency, or a government agency shall be allocated on average not exceeding 3 people per unit.
Units specified in point a, clause 1 (excluding units under the organizational structure of a ministry, a ministerial-level agency, or a government agency), clause 2, and point a, clause 4 of Article 2 of this Decree, with 20 or fewer employees shall be allocated not more than 2 deputy directors; with 20 or more employees shall be allocated not more than 3 deputy directors.
Units specified in point b, c, d, and đ, clause 1, clause 3, point b, c, d, clause 4, and clause 5 of Article 2 of this Decree, general education schools with multiple levels of education with a scale of 40 classes or more shall be allocated not more than 3 deputy directors.
In an interview with Lao Động Newspaper, Lawyer Nguyễn Phó Dũng, Director of OPIC Law Firm and Associate, Hanoi Bar Association, said:
“Based on the above content, from 1.9.2024, general education schools with multiple levels of education, including elementary and junior high schools; junior high schools and high schools; elementary, junior high, and high schools with 40 or more classes shall be appointed up to 3 deputy directors, while other schools shall be appointed a maximum of 2 deputy directors” - Lawyer Dũng said.
