The Ministry of Transport has just issued Document No. 1657 /BGTVT-CDCTVN dated February 19, 2025 on resolving the petition of the People's Committee of Bac Ninh province related to Component Project 1.3 of the Investment Project to build Ring Road 4 - Hanoi Capital Region.
The People's Committee of Bac Ninh province proposes to have specific regulations on the implementation of the items of relocation and return of technical infrastructure for underground and above-ground works to serve site clearance work to ensure consistency and synchronization between localities when implementing Component Project 1.3, Ring Road 4 project of Hanoi Capital Region, the section passing through Bac Ninh province.
Regarding the content of the proposal of the People's Committee of Bac Ninh province, the Ministry of Transport has the following opinion:
The investment project to build Ring Road 4 - Hanoi Capital Region (Project) was approved by the National Assembly in Resolution No. 56/2022/QH15 dated June 16, 2022.
The Government issued Resolution No. 106/NQ-CP dated August 18, 2022 to implement the National Assembly's Resolution, accordingly, at Point d, Clause 7, Article 1 of the Resolution of the Government, the Ministry of Natural Resources and Environment was assigned to preside over and guide, resolve according to its authority or advise the Government and the Prime Minister to remove obstacles in compensation, support, and resettlement; exploitation of mineral mines for common construction materials for the Project and at Point k, Clause 7, Article 1 assigned to the Hanoi People's Committee.
Perform the responsibility of the governing body, act as the unit to organize the implementation and report on the implementation results of the Project, ensure the overall and synchronous nature of the entire Project and preside over the report to competent authorities for consideration and decision on the adjustment of the Project investment policy in case of arising factors leading to the need to adjust the Project investment policy.
On December 26, 2024, the Government issued Decree No. 165/2024/ND-CP detailing and guiding the implementation of a number of Articles of the Road Law and Article 77 of the Law on Road Traffic Order and Safety, which stipulates land for road protection and maintenance; road safety corridors; construction works within the scope of road infrastructure protection; road infrastructure protection.
The relocation of technical infrastructure is an item of compensation, support and resettlement under the Project responsible for organizing the implementation of compensation, support and resettlement work under the locality.
Based on the above regulations, the Ministry of Transport requests the People's Committee of Bac Ninh province to study and implement the relocation and return of technical infrastructure for underground and above-ground works to serve site clearance work to ensure compliance with legal regulations and synchronization between component projects according to the direction of the Government.
In case of problems, it is recommended that the People's Committee of Bac Ninh province agree with the People's Committee of Hung Yen province and the People's Committee of Hanoi city, work with the Ministry of Natural Resources and Environment for guidance and resolution to ensure the project implementation progress as required.
