A reader sent a question to the Ministry of Finance, wondering about registering a business when establishing a business household.
The reader said: "I am in need of establishing a business household and plan to register for some of the following business lines:
1. Information technology services and other services related to computers (industrial code: 6209)
2. Computer consulting and computer system administration
3. Management, warranty, and maintenance services of software and information systems
4. Consulting, evaluation, and software quality testing services
5. Writing, editing, testing and supporting software according to the specific requirements of each customer.
6. Renting a house (Land use right under the owner) (industry code: 6810).
So can business households register for the above professions? Are the above professions on the list of professions banned from trading, do they have conditions or need to meet specific legal regulations?
If I need to add specific industry codes according to the Vietnam Economic Sector System, I hope the Ministry of Finance will guide me".
Regarding this content, the Ministry of Finance responded as follows:
Industries and professions prohibiting business investment are stipulated in Clause 1, Article 6 of the Law on Investment 2020 and Clause 2, Article 2 of the Law amending the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership method and the Law on Bidding 2024.
Conditional business investment and industries are specified in Appendix IV the list of conditional business industries and industries issued together with the Investment Law; Clause 5, Article 3 of the Law amending the Law on Public Investment, the Law on Investment by the method of public -private partnership, the Law on Investment, the Housing Law, the Bidding Law, the Electricity Law, the Enterprise Law, the Special Consumption Tax Law and the Civil Judgment Execution Law 2022; Clause 1, Article 2 of the amended Radio Frequency Law 2022; Clause 1, Article 63 of the 2024 Archive Law; Article 155 of the Law on Insurance 2022; Point c, Clause 11, Article 2 of the Law amending the Planning Law, the Law on Investment, the Investment Law according to the public -private partnership method and the Bidding Law 2024; Point a Clause 18, Article 6 of the Law amending the Bidding Law, the Law on Investment by the method of public -private partnership, the Customs Law, the Value -added tax law, the Law on Export Tax, the Import Tax, the Law on Investment, the Law on Public Investment, the Law on Management and Use of Public Assets 2025.
Clause 1, Article 89 of Decree No. 168/2025/ND-CP dated June 30, 2025 of the Government on business registration stipulates: busines have the right to freely do business in industries and occupations that are not prohibited by law. For sectors and professions with conditions for business investment, business households are only allowed to do business when they meet the conditions for business investment and must ensure that those conditions are maintained throughout the business operation process".
The recognition of business sectors and occupations of business households is stipulated in Clause 2, Clause 3, Article 89 of Decree No. 168/2025/ND-CP.
According to the provisions of Clause 2, Article 89 of Decree No. 168/2025/ND-CP, the Commune-level Business Registration Agency shall guide, compare and record the business lines and occupations of business households in the database on business household registration. Therefore, it is recommended to contact the Commune-level Business Registration Agency where the business household is headquartered for instructions.
In addition, the Prime Minister issued Decision No. 27/2018/QD-TTg dated July 6, 2018 promulgating the Vietnam Economic Sector System, requesting readers to refer to and comply with legal regulations.
