The People's Committee of Bac Ninh province has just issued a Decision to sanction administrative violations in the field of land against Nhat Quang Kinh Bac Joint Stock Company.
This company has its head office at: No. 128, Nguyen Gia Thieu Street, Kinh Bac Ward, Bac Ninh Province.
Legal representative: Duong Van Hau, title: director.
The above enterprise committed an administrative violation: Encroaching on land managed by state agencies and organizations.
Accordingly, in 2017, Nhat Quang Company Limited (now Nhat Quang Kinh Bac Joint Stock Company) was granted an investment approval decision by the People's Committee of Bac Giang province (now Bac Ninh province) for the project of Zone 4, Bich Dong town residential area, Viet Yen district, Bac Giang province (now Viet Yen ward, Bac Ninh province).
On April 22, 2025, the People's Committee of Bac Giang province issued a Decision to adjust the investment policy of the project in Zone 4, Bich Dong town residential area, Viet Yen district, Bac Giang province.
By 2025, the project still has 20,883.7m2, the land area of the People's Committee of Viet Yen town (old) has been reclaimed to implement the project but has not changed the purpose and has not yet allocated land to the Investor.
From December 1, 2020 to June 16, 2025, when not yet allocated land and allowed to change the land use purpose, Nhat Quang Kinh Bac Joint Stock Company has leveled, built roads, sidewalks, and constructed infrastructure for land division to encroach on part of the above land area.
At the time of inspection on June 16, 2025, the results were recorded: Of the total area of 20,883.7m2 of land that had not been allocated, Nhat Quang Kinh Bac Joint Stock Company encroached on a total area of 12,009.8m2 (more than 1.2 ha).
Violations shall be based on the provisions of: Point e, Clause 1, Clause 6, Article 13 of Decree No. 123/2024/ND-CP dated October 4, 2024 of the Government on administrative sanctions in the field of land.
The fine is 500 million VND.
Nhat Quang Kinh Bac Joint Stock Company must restore the land to its original state before the violation (including restoring the boundary and boundary markers of the land plot). The total restored area is: 12,009.8m2.
At the same time, they are required to return the illegal profits gained from the violation according to regulations. The amount of illegal profits to be returned is 455,778,132 VND.
The deadline for implementing remedial measures is 20 days from the date of receipt of this Decision.
