In the minutes of the summary of comments on the Policy dossier of the Draft Law on Tax Administration (replacement) published by the Ministry of Finance in July 2025, many contents related to business households and individuals are being proposed by localities and organizations to be adjusted in the direction of tightening management and approaching the business model.
Hanoi People's Committee proposes requiring business households to open separate accounts
The Hanoi People's Committee proposed that the Ministry of Finance supplement the regulation: "business households are required to register bank accounts/ electronic transactions for business alone. Applying the rule of creating a separate transaction account helps control cash flow more conveniently".
This locality also proposed connecting data between business registration and tax registration: "Proposed to add regulations on connecting business registration and tax registration for business households, similar to business registration, reducing administrative procedures for taxpayers".
Regarding the concept, the Hanoi People's Committee said:
According to the provisions of Articles 2 and 3 of the draft Law, the concept of business household is oriented to be eliminated, leaving only the concept of business individual. However, in all documents sent for comments, there are still many contents using the phrase "business household".
The Hanoi People's Committee further analyzed:
The current law on business registration does not have the concept of business individual. According to Article 88 of Decree 01/2021/ND-CP, a business household is an entities with a separate name and business registration. The use of the concept of business individual is unclear and may cause confusion.
Therefore, the Hanoi People's Committee recommends that the Ministry of Finance review and agree on the method of identifying management subjects to comply with current laws.
Regarding the regulation on applying electronic invoices from cash registers, the Hanoi People's Committee believes that it is necessary to clarify the revenue threshold and feasibility:
"The proposal to amend the content of detailed regulations on revenue thresholds for business households must apply electronic invoices generated from cash registers. This requirement in the Law is not consistent with reality, in the context of the economy emerging many new models".
According to the summary minutes, the Ministry of Finance acknowledged and studied the comments of the Hanoi People's Committee.
Vietnam Academy of Social Sciences warns of implementation risks and proposes roadmap
The Vietnam Academy of Social Sciences supports the modernization of tax management methods for business households, but also clearly states the potential risks in the conversion process:
"In the first phase of implementation (2025-2026), there may be a situation of system overload when millions of business households are converting. We need to invest heavily in technology infrastructure and train technical support teams.
The Institute proposes a 5-year conversion roadmap, divided into three phases:
Year 12: preparing technical foundation, software, training, and communication.
In 24: pilot implementation of compulsory declaration for households with large revenues.
In 45: widely applied, completely ending the contract mechanism.
In addition, to ensure compliance, the Institute recommends: "The State needs to provide free basic accounting software, support conversion costs, especially for business households in remote areas and micro-scale households".
Responding to the Academy's comments, the Ministry of Finance said: Resolution No. 198/2025/QH15 stipulates that from January 1, 2026, the form of tax contracts will be abolished, so the Law on Tax Administration will have to amend the regulations on tax management policies for business households to implement according to the self-declaration method from January 1, 2026.
"The draft Law will stipulate a model of tax management for business households in accordance with the specialties of this subject" - the drafting agency stated.
