The Ministry of Home Affairs is seeking people's opinions on the Draft Decree detailing the implementation of a number of articles of the Law on Occupational Safety and Health.
According to the draft report of the Decree, the drafting agency said that initially, the Draft Decree was built in the form of a Decree amending and supplementing a number of articles, with the expected scope only adjusting the contents that are still inadequate arising in the process of organization and implementation.
However, in the context of the legal system having many changes, especially related legal normative documents, many contents of the current Decree need to be comprehensively amended and supplemented to ensure synchronization and unity.
After receiving opinions from ministries, branches and localities, the total number of articles proposed for amendment, supplementation and new construction is 29 articles (out of a total of 48 articles of Decree No. 39/2016/ND-CP).
Therefore, the Draft Decree has been adjusted in the direction of building a Decree detailing the implementation of a number of articles of the Law on Occupational Safety and Health, replacing Decree No. 39/2016/ND-CP.
Regarding statistics and reporting of labor accidents, the draft has transferred the statistics and reporting of labor accidents for workers working under labor contracts to the commune-level People's Committee.
According to current regulations, businesses will report to the Department of Home Affairs. The draft has stipulated that businesses report to the Commune People's Committee; the Commune People's Committee will report to the Department of Home Affairs; the Department of Home Affairs will report to the Ministry of Home Affairs.
This regulation helps the commune-level People's Committee have comprehensive information on labor accidents in both labor-related and non-labor-related areas to serve management (current regulations stipulate that commune-level People's Committees only statistically report labor accidents for people working without labor contracts).
In parallel with that, to reduce the information burden for commune-level People's Committees, the draft has stipulated the responsibility of employers in updating work accident information to the work accident database; electronic reports are as valuable as paper reports. This decentralization is consistent with the current situation and the trend of digital transformation, building a database.
