From 2026, the organization of professional departments under the commune-level People's Committee will be implemented according to new regulations in Decree No. 370/2025/ND-CP and Decree No. 361/2025/ND-CP of the Government on job positions (VTVL) for civil servants.
These regulations aim to concretize the model of local government organization in the direction of clearer decentralization and delegation of power, while creating room for localities to proactively arrange the apparatus in accordance with reality.
34 job positions in 11 fields
According to Decree 361/2025, the determination of civil servant VTVL is carried out based on the functions and tasks of each agency and unit, ensuring a reasonable structure between leadership and management positions and professional and nghiệp vụ positions.
The list of VTVL civil servants at commune level includes 42 positions (excluding support positions, not arranging civil servants), of which the group of professional and nghiệp vụ positions has 34 positions, divided into 11 state management fields.
These professional and nghiệp vụ positions are mainly arranged in professional departments, focusing on fields such as office - administration; internal affairs; justice; finance - planning; construction, urban areas; industry and trade; agriculture and rural development; education and training; culture, science and information; health.
Each field is defined from 1 to 4 VTVL, depending on the nature, management scope and workload, such as the field of agriculture and rural development with 4 positions, while the fields of justice, industry and trade, education and training, and healthcare only arrange 1 position.
These positions are all identified as professional and nghiệp vụ civil servant VTVL, arranged according to specialist and equivalent ranks, as a basis for recruiting, using, managing and evaluating civil servants associated with the task requirements of each professional department.
In addition, 8 civil servant positions can be used in specialized departments according to the decision of competent authorities, in accordance with the functions and tasks of the department, such as legal affairs, ethnicity, specialized inspection, clerical, archival, accounting, and personnel. The arrangement of these positions in each specialized department is based on management requirements, workload and local practical conditions, not rigidly applied to all commune-level administrative units.
The professional department is the advisory body of the commune-level People's Committee.
According to Decree No. 370/2025, the professional department is a specialized agency under the commune-level People's Committee, with its own seal and account, operating in accordance with the law on performing assigned tasks. The department has the function of advising and assisting the commune-level People's Committee in implementing state management according to sectors and fields in the locality.
The head of the professional department is the head of the department, appointed by the Chairman of the commune-level People's Committee, responsible to the People's Committee, the Chairman of the commune-level People's Committee and before the law for all activities of the department.
The Deputy Head of Department is the person who assists the Head of Department in directing some aspects of work, and is responsible to the Head of Department for the assigned tasks; when the Head of Department is absent, the Deputy Head of Department is authorized to manage the department's activities.
Flexible number of rooms depending on local conditions
Accordingly, the Provincial People's Committee decides on the framework of the number and name of commune-level professional departments, based on industry groups and management fields; population size; natural area; development level; socio-economic conditions and the level of decentralization and delegation of power between levels of government.
