The Ministry of Justice is appraising the dossier of the Draft Decree stipulating penalties for administrative violations in the field of environmental protection drafted by the Ministry of Agriculture and Environment.
In the draft, the Ministry of Agriculture and Environment proposes to impose a warning or a fine of between 50,000 VND and 100,000 VND for the act of not listing regulations on environmental sanitation in public places.
The act of collecting and discharging waste and wastewater in violation of environmental protection regulations shall be penalized as follows:
a) A fine of between 100,000 VND and 150,000 VND shall be imposed for the act of throwing, discharging, removing cigarette butts, scraps, and ashes in the wrong places in apartment buildings, commercial and service areas, or public places;
b) A fine of between 150,000 VND and 250,000 VND shall be imposed for acts of personal hygiene (urination, bowel movements) not in the prescribed places in apartment buildings, commercial areas, services or public places;
c) A fine of between 500,000 VND and 1,000,000 VND shall be imposed for acts of littering, discharging, abandoning waste, and dumping wastewater in the wrong places in apartment buildings, commercial areas, services, or public places, except for violations specified in point d of this clause;
d) A fine of between VND 1,000,000 and VND 2,000,000 shall be imposed for acts of littering, discharging, or abandoning waste on sidewalks, roads, or into wastewater drainage systems or surface water drainage systems; dumping wastewater improperly on sidewalks, roads; discharging solid waste generated from daily life into ponds, lakes, canals, rivers, streams, and seas.
In the above draft, individuals and organizations violating administrative regulations in the field of environment are subject to one of the main forms of punishment including: Warning; a maximum fine of 1 billion VND for individuals and 2 billion VND for organizations.
