The Department of Construction Infrastructure (Ministry of Construction) has just issued document 1161/KCHT-HTĐT on the communication of the draft Circular promulgating the National Technical Regulation on Parks and Green Trees.
According to the Department of Construction Infrastructure, in the current national technical regulations and standards system, although there are already QCVN 01:2026/BXD (regulations on general construction planning) and TCVN 9257:2012 (regulations on public-use green tree planning), these documents have not set specific and detailed requirements for the design of park works and public-use green trees. This leads to a lack of tools to serve design consulting organizations as well as state management agencies in the work of reviewing and appraising.
On the other hand, the technical guidance contents on urban green tree management previously included in legal documents (Circular No. 20/2005/TT-BXD and Circular No. 20/2009/TT-BXD) should be issued in the form of Technical Regulations. Therefore, the issuance of the "National Technical Regulation on Parks and Green Trees" is extremely necessary to establish a unified legal framework to improve the quality of green spaces, improve the living environment and increase the adaptability to climate change of urban and rural areas.
The basic content of the Draft National Technical Regulation on Parks and Green Trees has a structure consisting of 5 main parts. Accordingly, the general regulation part determines the scope of regulation for investment in new construction, renovation, upgrading of park works and investment in planting and developing public-use green trees in urban and rural residential areas.
Technical regulations - this is the core content of the regulation, establishing mandatory application requirements including: Ensuring compliance with planning, local identity, climate change adaptation and meeting access to use for people with disabilities.
For parks, regulations on park classification; main functional areas; land use requirements, landscape space organization; strict control of business areas in parks.
In addition, there are requirements for security and safety (surveillance camera system, night lighting); technical and environmental infrastructure (transport organization, electricity supply, water supply and drainage, underground wastewater treatment station, distance and scale of public toilets); information requirements, bilingual signs and maintenance and repair work.
For publicly used green trees, regulations on classification; standards for shade trees when planted; detailed requirements when planting green trees on sidewalks, medians, traffic islands and requirements for planting land plots and public green spaces.
The part regulating management, stipulating the mandatory application of the standard and transitional clauses for projects approved before and after the standard takes effect.
The draft also clearly defines the compliance responsibilities of organizations and individuals participating in the construction of parks and green trees as well as the inspection and supervision responsibilities of state management agencies in localities.
