The case of the “most beautiful villa in Ca Mau” has just had a dramatic change from the local government: On October 7, the People’s Committee of Ca Mau province sent a document requesting the People’s Committee of Ca Mau city to review the process of handling land violations against Mr. Ho An Tap, the owner of the “most beautiful villa in Ca Mau”.
The exciting thing is that before that, after a long time of handling with many inconsistent actions, the People's Committee of Ca Mau city finally chose the option of allowing the "most beautiful villa in Ca Mau" to exist.
Mr. Ho An Tap, the villa owner, is taking steps to convert aquaculture land to residential land in accordance with regulations.
According to the announcement from the Ca Mau Provincial Tax Department, the amount of money Mr. Ho An Tap must pay to convert the land use purpose and legalize all illegal construction works is more than 8 billion VND, instead of more than 10 billion VND as previously announced.
Returning to the latest document of the People's Committee of Ca Mau province, this document requests the People's Committee of Ca Mau city to handle the case in accordance with the law, based on Report No. 683 dated September 27 of the Department of Justice of Ca Mau province.
Report No. 683 of the Department of Justice of Ca Mau province clearly stated that the decisions on administrative sanctions and forced remediation of consequences for Mr. Ho An Tap's violations were not in accordance with legal regulations and must be annulled.
Notably, the "most beautiful villa in Ca Mau" according to the law should have had its land confiscated, not just forcibly demolished as previously decided.
The correct legal handling, according to the Ca Mau Department of Justice, is to force Mr. Ho An Tap to restore the original state of the land before the violation for the area of 1,303m²; at the same time, force land registration (change of land use purpose) for the remaining area of 2,261m²; force the return of illegal profits gained from the violation (on the total area of violation).
In case Mr. Tap fails to implement or does not fully implement the above remedial measures, the competent authority will carry out land recovery procedures according to the provisions of law.
The decision of the People's Committee of Ca Mau province to request the People's Committee of Ca Mau city to re-handle the case of the "most beautiful villa in Ca Mau" in accordance with the law, instead of just paying more than 8 billion VND to change the land use purpose to legalize the violation, is a correct and very welcome decision.
This decision shows that after being repeatedly led by various reasons, in the end, the fairness and strictness of the law in this case still cannot be challenged.
Justice in the case of the “most beautiful villa in Ca Mau” must be enforced and cannot be “distorted” in exchange for the amount of 8 billion VND to change the land use purpose. To see that, not only Mr. Ho An Tap, but anyone who violates the law must be treated strictly and fairly!
