The case of building a house on someone else's land in Hai Phong has received much public attention. Many opinions said that this was an act of appropriating property.
Ms. Tran Thi Kim Loan - the owner of the land - said that Mr. Do Van Huu deliberately built it, because when Ms. Loan discovered and blocked it, Mr. Huu still continued to build.
The local government also asked Mr. Do Van Huu to stop construction twice. This shows that Mr. Huu deliberately built a house as if it had happened, and the landowner must accept it.
Here, I would like to also raise the issue of the responsibility of the government, point out the request without handling it resolutely. If the local government completely stops and does not allow Mr. Huu to continue building the house, it will not lead to a lawsuit and other consequences.
The court ordered Mr. Do Van Huu to move all his belongings and dismantle all construction works on Ms. Loan's land, but Mr. Huu still did not comply.
Mr. Do Van Huu appealed the case, saying it was a time-wasting trick to find a way to deal with the landowner and the government.
Therefore, the court needs to comply with the provisions of the Civil Procedure Code on "Cases for appeal trial" and " appellate trial preparation deadline", promptly resolve the case, protect the rights of the victims.
At this time, Mr. Do Van Huu was in the water, considering moving the house. Mr. Huu added that the appeal court could not stand on his side, and was clearly wrong to demand legal protection.
After the appeal hearing, if there is no change to the first instance judgment, Mr. Do Van Huu must proactively relocate and dismantle it. Or, local authorities must enforce the judgment.
In case Mr. Do Van Huu opposes the authorities, does not comply with the judgment, and illegally detained property, criminal proceedings will be held.
Public opinion is monitoring this incident to see how the local government will handle it and whether the law is strictly enforced or not.
If a case of " mistakenly" building a house on someone else's land is left openly, many people will appropriate citizens' property by deliberately building a house by mistake on someone else's land.
At that time, people whose land is occupied to build a house will suffer a lot, losing time and money to file a lawsuit. The government must solve it, the court, the entire executive and judicial system must shoulder additional burden for greedy people, defying the law.
The law has no place for citizens to violate regulations, the government does not cover up those who violate and disregard the law.
