2 circulars guiding payment of benefits to officials when streamlining

Currently, there are 2 circulars related to the implementation of Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees and workers when streamlining.

The Government issued Decree No. 178/2024/ND-CP dated December 31, 2024, stipulating the regime and policies for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.

In Decree No. 178/2024/ND-CP, the Government stated the responsibilities of the Ministry of Home Affairs including: Guiding the implementation of policies and regimes prescribed in this Decree.

Check the implementation of regulations on policy and regime settlement at ministries, branches and localities.

Coordinate with competent authorities to direct Social Insurance agencies and relevant agencies to resolve social insurance and unemployment insurance regimes for beneficiaries according to the provisions of law on social insurance and unemployment insurance.

After that, the Ministry of Home Affairs issued Circular 01/2025/TT-BNV dated January 17, 2025 guiding the implementation of policies and regimes for cadres, civil servants, public employees and workers in the implementation of organizational arrangement of the political system.

Regarding the responsibility of the Ministry of Finance, the Government also clearly stated in Decree 178/2024: Guiding the determination of funding sources and the preparation of estimates, management, use and settlement of funding for implementing policies prescribed in this Decree.

Arrange funding to implement policies and regimes, submit to competent authorities for decision according to the provisions of the State Budget Law.

Direct the Social Insurance agency to calculate the state budget amount to ensure it is equivalent to the amount of social insurance contributions to the retirement and death insurance fund prescribed in Clause 4, Article 16 of this Decree.

Immediately afterwards, the Ministry of Finance issued Circular No. 07/2025/TT-BTC dated January 24, 2025 guiding the determination of funding sources and the preparation of estimates, management, use and settlement of funding for policy implementation in Decree No. 178/2024/ND-CP.

In which, agencies and units use the annual regular expenditure budget estimate to pay for:

Funds to retain the old position salary or old leadership position allowance until the end of the election term or the end of the appointment term for cadres, civil servants, leaders, and managers who cease to hold leadership or management positions or are elected or appointed to lower leadership or management positions due to organizational restructuring;

Funding continues to pay the full current salary (including salary allowances) according to the job position before being sent by the agency, organization or unit to work at the grassroots level;

Salary increase policy; Bonus payment for subjects.

Also according to this Circular, the state budget allocates funds to implement the remaining policies and regimes (in addition to the above regimes) in Articles 7, 8, 9, 10, 12, and 15 of Decree No. 178/2024/ND-CP.

Accordingly, for cadres, civil servants, public employees, workers, and armed forces under the management of ministries, ministerial-level agencies, government agencies, and other central agencies, the central budget shall ensure.

For cadres, civil servants, and public employees; commune-level cadres and civil servants and employees of or directly under units managed by the locality, the budget for implementing the regime and policies is included in the locality's salary reform needs.
