Decree 300/2026/ND-CP amending and supplementing a number of articles of Decree No. 170/2025/ND-CR of the Government regulating the recruitment, use and management of civil servants takes effect from August 1.
The Decree stipulates the change of job positions for civil servants.
In principle, ensuring the correlation between the expected job position arranged and the qualifications, capacity, and performance of civil servants, is determined based on specific criteria on: Level of task completion; difficulty and complexity of tasks; requirements for progress, quality of results, output products; responsibilities of individuals in performing tasks; the importance and impact of the assigned work on the overall operating results of agencies, organizations, and units;
Ensure the proportion of civil servants to be arranged according to job positions in agencies using civil servants that have been approved by competent authorities.
Ensure publicity, transparency, objectivity, fairness and proper authority; promote the role and responsibility of heads and collective leaders, Party committees of civil servant agencies in evaluating and arranging civil servants according to job positions.
Cases of job change include:
(1) Being appointed to leadership and management positions or ceasing to hold leadership and management positions according to decisions of competent authorities on personnel work;
(2) Being assigned to a job position with a civil servant rank rank ranked higher in professional qualifications than the current rank;
(3) Being assigned to a job position with a civil servant rank in the same professional and nghiệp vụ rank as the current rank held;
(4) Being assigned to a job position with a civil servant rank ranked in terms of expertise and nghiệp vụ lower than the current rank held.
Regarding standards and conditions for civil servants when changing positions:
For the cases specified in (1), civil servants must meet the standards and conditions for appointment to leadership and management positions according to the regulations of competent authorities on personnel work.
For the cases specified in (2), civil servants must meet all the following standards and conditions:
Meeting the standards and conditions on capacity, professional qualifications, and nghiệp vụ according to the requirements of the job description and the expected job position capacity framework;
Being classified as having completed tasks well or better in the work year immediately preceding the year of job change;
Not within the time limit for disciplinary action; not within the time of complying with the disciplinary decision; not within the time of being prosecuted, investigated, prosecuted, or tried; not within the time of implementing regulations related to discipline according to Party regulations and the law;
Have directly advised on work with complexity, scope and capacity requirements equivalent to the expected position assigned; have task performance results shown through the quantity, quality and progress of products at the assigned job position in accordance with the expected job position assigned.
For the cases specified in (3), civil servants must meet the standards and conditions on capacity, professional qualifications, and nghiệp vụ according to the requirements of the job description and the expected job position capacity framework.
For the cases specified in (4), the competent authority shall consider and decide to change the job position when there is one of the following grounds:
Civil servants who do not meet the task requirements according to the results of regular monitoring and evaluation or quality classification do not complete their tasks according to the results of annual quality assessment and classification.
In case there is no job position suitable to the capacity and qualifications or there is a suitable job position but enough number has been arranged according to the proportion of civil servants approved by competent authorities, the competent authority shall consider and decide to dismiss them and resolve regimes and policies according to regulations.
