Decree 300/2026/ND-CP amending and supplementing a number of articles of Decree No. 170/2025/ND-CR of the Government regulating the recruitment, use and management of civil servants takes effect from August 1.
According to the new regulations, based on the need to use human resources that immediately meet job requirements, the head of the competent recruiting agency shall consider and receive them to become civil servants for the following subjects:
- Experts, scientists, jurists, good lawyers, typical and outstanding entrepreneurs working in agencies, organizations, and units outside the public sector under the policy of attracting talented people;
- Officials;
- Salaried people in the People's Army, People's Police, cipher organizations who are not civil servants;
- People holding leadership and management positions and titles from the department level upwards in enterprises where the State holds 100% of charter capital or in enterprises where the State holds over 50% of charter capital or the total number of voting shares;
- People who were formerly cadres and civil servants and then were decided by competent authorities to transfer to work at other agencies, organizations, and units that are not cadres or civil servants;
- People recruited according to staffing quotas assigned by competent authorities to work in associations assigned tasks by the Party and State;
- Team members of the Project piloting the selection of young intellectuals to volunteer to communes to participate in rural and mountainous development in the period 2013 - 2020, after the Project ends, continue to sign labor contracts to work in communes.
Regarding procedures for receiving civil servants, based on the need to use human resources that immediately meet the job requirements of agencies, organizations, and units, the person in charge of personnel organization work of the competent recruiting agency shall study and propose the reception of people who meet the standards and conditions according to regulations.
The head of the recruiting authority decides to receive civil servants according to their authority.
When receiving to become civil servants for appointment to leadership and management positions, it is carried out according to the appointment procedure for personnel sources from other places. The appointment decision is also the decision to receive to become civil servants.
In case the competent authority for appointment is a subordinate of the competent authority for recruitment, the competent authority for appointment must report and be approved by the competent authority for recruitment for the reception before issuing the appointment decision.
Regarding the recruitment and employment decisions, at the latest 3 working days from the date of expiration of the deadline for completing the recruitment dossier as prescribed, the head of the recruiting authority issues the recruitment decision and sends it to the successful candidate.
The content of the recruitment decision includes recruitment, job position arrangement and rank corresponding to the recruited job position.
No later than 15 days from the date of receiving the recruitment decision, the recruited person must come to receive the job, except in cases where the recruitment decision stipulates another deadline or is agreed to be extended by the recruiting authority.
In case the recruited person does not come to work within the prescribed time limit, the recruitment decision will naturally expire, unless approved by the head of the competent recruiting agency. The agency using civil servants reports to the competent recruiting agency to perform the prescribed tasks.
