Decree 300/2026/ND-CP amending and supplementing a number of articles of Decree No. 170/2025/ND-CR of the Government regulating the recruitment, use and management of civil servants takes effect from August 1.
Decree 300/2026/ND-CP, amending and supplementing Article 24 on salary ranking in civil servant ranks corresponding to job positions.
When civil servants change to a new job position, they are ranked in the salary rank corresponding to that job position. The time to receive salary in the civil servant rank equivalent to or higher than the current rank is kept as the basis for ranking salary in the civil servant rank corresponding to the new job position.
Salary ranking for cases of being appointed and arranged for positions with civil servant ranks ranked according to professional and nghiệp vụ ranks higher than the current rank:
Based on the salary coefficient plus seniority allowance exceeding the frame (if any) being enjoyed to be ranked into the salary coefficient equal to or higher than the nearest in the rank corresponding to the new job position;
In case the total salary coefficient plus seniority allowance exceeding the frame (if any) currently enjoyed in the current rank is greater than the salary coefficient at the last level of the rank corresponding to the new job position, it is classified into the salary coefficient at the last level in the rank corresponding to the new job position and is entitled to an additional reserve difference coefficient equal to the total salary coefficient plus seniority allowance exceeding the frame currently enjoyed.
Salary ranking for cases of being appointed and arranged for positions with civil servant ranks of the same professional and nghiệp vụ rank as the current rank:
In case the current rank and the rank corresponding to the new job position have the same salary grade coefficient, they are ranked equal to the salary grade and the percentage of seniority allowance exceeding the frame (if any) being enjoyed in the current rank;
In case the rank corresponding to the new job position has a salary coefficient of the same rank higher than the current rank, it shall be based on the salary coefficient plus seniority allowance exceeding the frame (if any) being enjoyed to be ranked into the salary coefficient equal to or closest to higher in the rank corresponding to the new job position;
In case the rank corresponding to the new job position has a salary coefficient of the same rank lower than the current rank, it is ranked equal to the salary rank and the percentage of seniority allowance exceeding the frame (if any) being enjoyed in the current rank to the rank corresponding to the new job position and is entitled to an additional reserve difference coefficient equal to the salary coefficient (including seniority allowance exceeding the frame, if any) being enjoyed.
Salary ranking for cases of being appointed and arranged for positions with civil servant ranks ranked according to professional and nghiệp vụ ranks lower than the current rank:
In case civil servants do not meet the task requirements according to the results of regular monitoring and evaluation, or the quality classification does not complete the task according to the annual evaluation and classification results, it is based on the salary grade held at a lower rank corresponding to the new job position and the salary period at a higher rank compared to the rank corresponding to the new job position to rank salary at the new job position.
In case civil servants voluntarily change their job position and are agreed by competent authorities, they are ranked according to regulations and are entitled to an additional reserve difference coefficient equal to the salary coefficient (including seniority allowance exceeding the frame, if any) they are currently receiving.
The Ministry of Home Affairs is assigned to guide the salary ranking for civil servants when changing positions.
