The Ministry of Public Security proposes to increase prison sentences related to drug crimes

In the Draft Penal Code (amended), the Ministry of Public Security proposed raising the prison sentence for drug-related crimes.

The Ministry of Public Security has just completed the draft Penal Code (amended) expected to be submitted to the National Assembly for consideration and comments at the 9th Session of the 15th National Assembly. In particular, the draft Law proposes to amend regulations related to drug crimes.

Accordingly, regarding drug crimes, the draft Law proposes to increase the prison and money sentences for some crimes and some acts to ensure deterrence to improve the effectiveness of crime prevention and control, promptly protect the legitimate rights and interests of the State and citizens.

The draft Penal Code (amended) proposes to increase the prison sentence for some of the following drug criminals:

Crime of illegal drug trafficking: Increase the minimum prison sentence from 2 years to 3 years in Clause 1.

Crime of illegal drug production: Increase the minimum prison sentence from 2 years to 3 years in Clause 1.

Crime of illegal transportation of drugs: Increase the minimum prison sentence from 2 years to 3 years in Clause 1.

Crime of drug possession: Increase the minimum prison sentence from 1 year to 2 years in Clause 1.

Crime of storing, transporting, trading or appropriating precursors for illegal production of narcotics: Increasing the lowest imprisonment level from 1 year to 6 years to 2 years to 7 years in Clause 1; increase imprisonment penalties from 6 years to 13 years to 7 years to 15 years in Clause 2; The lowest increase from 13 years to 15 years in Clause 3.

The crime of manufacturing, storing, transporting or trading means and tools used in illegal drug production: Increase the minimum prison sentence from 1 year to 2 years in Clause 1.

Crime of organizing illegal use of drugs: Increase the minimum prison sentence from 1 year to 2 years in Clause 1.

Crime of enticing others to illegally use drugs: Increase the minimum prison sentence from 1 year to 2 years in Clause 1.

Crime of illegal use of drugs: Increase the minimum prison sentence from 2 years to 3 years in Clause 1.

The crime of forcing others to illegally use drugs: Increase the minimum prison sentence from 2 years to 3 years in Clause 1.
