Reporting to the Ministry of Public Security's Electronic Information Portal, voters in Bac Lieu province said that in rural areas, there have been and are cases of groups of scammers selling people abroad.
Therefore, voters of Bac Lieu province proposed that the Ministry of Public Security submit to the National Assembly to supplement legal provisions in the draft Law on Prevention and Combat of Human Trafficking (amended) to regulate and handle acts of fraud in selling people abroad in a more severe direction.
For domestic crimes, it is recommended to design a penalty framework of the death penalty; for cases of overseas Vietnamese, the penalty is not to enter Vietnam;
For foreigners who commit crimes in Vietnam, they must coordinate with the country of nationality of that foreigner to handle them, including sanctions such as deportation and non-re-entry into Vietnam.
Regarding this content, the Ministry of Public Security has responded on the Electronic Information Portal.
According to the Ministry of Public Security, for crimes related to human trafficking, currently, according to the provisions of the 2015 Penal Code (amended and supplemented in 2017), the penalty applied to the crime of human trafficking (Article 150) has a maximum penalty of 20 years in prison; the crime of human trafficking under 16 years old (Article 151) has a maximum penalty of life imprisonment.
Thus, the punishment for trading crimes according to the provisions of the Penal Code has ensured the severity to deter this type of crime.
In Article 37, the Penal Code 2015 (amended and supplemented in 2017) stipulates that "the expulsion is forcing the convicted foreigner to leave the territory of the Socialist Republic of Vietnam. The expulsion is applied by the Court as the main penalty or additional penalty in each specific case" and Article 5 of Decree No. 142/2021/ND-CP of December 31 Administration in Vietnam.
For overseas Vietnamese, the penalty is not to enter Vietnam.
In recent times, the Party and State have always paid attention to directing the Ministry of Foreign Affairs to coordinate with the Ministry of Public Security and relevant ministries and branches to promptly implement measures to protect Vietnamese citizens who commit crimes abroad.
On November 28, 2024, the 15th National Assembly passed the Law on Prevention and Combat of Human Trafficking (amended), adding the concept of human trafficking and prohibited acts, ensuring compliance with international treaties, unification with the domestic legal system, meeting the requirements of the work of preventing and combating human trafficking in the new situation.
Therefore, the Ministry of Public Security suggested and expected voters and people to continue to pay attention to coordinating the implementation of the above law and actively participated in prevention, struggle, denunciation of criminals and violations of the law; At the same time, continue to respond, contribute ideas to improve the quality and effectiveness of preventive and fighting solutions with this crime in the coming time.
