One-time allowance when transferring to work out of areas with especially difficult socio-economic conditions or upon retirement is stipulated in Decree No. 76/2019/ND-CP.

Mr. Tran Van The has been working in Dak Dro commune, Krong No district, Dak Nong province since March 1, 2012 as an office worker - commune statistician.

Pursuant to Decision 433 of the Committee for Ethnic Affairs, Buon K62, Dak Dro commune where he is working is no longer a particularly difficult village. His total working time in the particularly difficult village is 9 years, 3 months and 17 days.

On September 16, 2021, the Committee for Ethnic Affairs issued Decision No. 612/QD-UBND replacing Decision No. 433/QD-UBDT dated June 18, 2021. According to this decision, his total working time in the particularly difficult village is 9 years, 6 months and 15 days.

Pursuant to Point b, Article 13 of Decree No. 76/2019/ND-CP of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions, the actual working time in areas with particularly difficult socio-economic conditions as a basis for calculating allowances and subsidies of more than 6 months shall be calculated as 1 year of work.

Regarding the reflection and recommendation of Mr. Tran Van The, the Ministry of Home Affairs said: One-time allowance when transferring to work out of areas with particularly difficult socio-economic conditions or upon retirement is stipulated in Article 8 of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions.

Accordingly, the subjects specified in Article 2 of this Decree who are working and have actually worked in an area with particularly difficult socio-economic conditions for 10 years or more, when transferring to work out of an area with particularly difficult socio-economic conditions or when retiring (or the place of work is decided by a competent authority to no longer be an area with particularly difficult socio-economic conditions), shall be entitled to a one-time allowance calculated based on the actual working time in an area with particularly difficult socio-economic conditions, paid by the agency, organization or management unit before transferring to work or when retiring (or the place of work is decided by a competent authority to no longer be an area with particularly difficult socio-economic conditions).

The implementation of regimes and policies for cadres, civil servants and public employees in Dak Nong province is under the authority of the Chairman of the People's Committee of Dak Nong province.
