Mr. Nguyen Van Minh (name changed) said that he graduated from university majoring in construction in 2010. After that, he worked at private enterprises in the fields of construction, supervision and project management to accumulate experience.
In 2013, he continued to study for a master's degree in construction and graduated in 2015, and also obtained construction professional certificates according to regulations.
Mr. Minh said that from the time he started working at the state agency in November 2014 to now, he has had nearly 12 years of working experience, but the current salary coefficient is 2.66.
With a master's degree and working experience in the field of construction, he requested the Ministry of Home Affairs to guide him on how to be considered for salary appropriate to his professional qualifications and job position (VTVL).
Regarding his proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Accordingly, Article 24 of the Law on Civil Servants No. 129/2025/QH15 dated December 10, 2025 (effective from July 1, 2026) stipulates: Civil servants are transferred to a new VTVL if they meet the standards and conditions of that VTVL and the unit still needs VTVL;
The change of VTVL is decided by competent authorities, ensuring publicity, transparency, objectivity and compliance with the law.
Implementing the Law on Civil Servants in 2025, the Government has issued Decree No. 232/2026/ND-CP dated June 26, 2026 regulating the VTVL of civil servants, No. 259/2026/ND-CP dated June 30, 2026 regulating the recruitment, use and management of civil servants.
Article 10 of Decree 259 stipulates salary ranking for people recruited and received as public employees.
People who are recruited and accepted into VTVL at any professional level are classified to enjoy the starting salary level of that professional level.
In case the person recruited as a civil servant has worked in accordance with the law in accordance with the professional qualification requirements of the recruited VTVL, has paid compulsory social insurance (BHXH) (if not continuously but has not received a one-time social insurance allowance or has not enjoyed the demobilization and discharge regime, it is accumulated), is assigned to work in accordance with the professional qualifications and skills previously held, the head of the agency or unit with recruitment authority shall base on that working time to consider and decide to rank it into the appropriate salary grade at the professional level of the recruited VTVL.
In case the person admitted to work as an official according to the provisions of this Decree has worked with compulsory social insurance contributions (if not continuously but has not received a one-time social insurance allowance or has not enjoyed the demobilization and discharge regime, it is accumulated) in accordance with the professional qualification requirements of the receiving VTVL, that working time is calculated as the basis for ranking salaries at the professional level of the receiving VTVL.
Based on the provisions of Article 58, Article 59 and Article 60 of Decree No. 259/2026/ND-CP, the Ministry of Home Affairs requests you to exchange with the civil servant management agency where you work for consideration and resolution.
