Recently, Dien Bien province requested the Ministry of Home Affairs to soon issue documents guiding the implementation of the process and procedures for recruiting commune-level civil servants according to Decree No. 33/2023/ND-CP of the Government.
Responding to Dien Bien province's proposal on this content, the Ministry of Home Affairs said that in Article 13 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups, it is stipulated: "The recruitment of commune-level civil servants is subject to the provisions of the Government's Decree on recruitment, use and management of civil servants".
Accordingly, the recruitment of commune-level civil servants is implemented in accordance with Decree No. 138/2020/ND-CP dated November 27, 2020 regulating the recruitment, use and management of civil servants (amended and supplemented in Decree No. 116/2024/ND-CP dated September 17, 2024).
Ha Tinh province also requested the Ministry of Home Affairs to issue regulations on the process and procedures for recruiting non-professional workers at the commune level.
Responding to Ha Tinh province, the Ministry of Home Affairs said that, based on Clause 8, Article 36 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune, village and residential group levels, the Provincial People's Committee shall base on relevant legal provisions to specify the management and use of each title of non-professional workers at the commune level in accordance with the reality of each locality (including regulations on the process and procedures for selecting non-professional workers at the commune level).
Accordingly, Article 36 clearly states: Standards, tasks, election, selection, reception, use, management, evaluation, classification, reward, discipline and dismissal, relief from duty, and termination of employment for part-time workers at the commune level.
The People's Committee at the provincial level shall, based on the provisions in Clauses 1, 2, 3, 4, 5, 6 and 7 of this Article, the provisions of the charter of the organization of which the part-time worker at the commune level is a member and the provisions of relevant laws, specifically stipulate the management and use of each title of part-time worker at the commune level in accordance with the reality of each locality.
