After the 7th session of the 15th National Assembly, voters of Quang Tri province made recommendations regarding policies for the Deputy Commander of the Commune Military Command.
According to voters of Quang Tri province, Article 20 of the 2019 Law on Militia and Self-Defense Forces stipulates that the position of Deputy Commander of the Commune Military Command is a non-professional person.
According to voters, with an important role as an advice force and directly participating in protecting the Party, government and people, in recent years, the Military Command at the commune level in localities across the country has always performed well its tasks in building a strong and comprehensive force.
"Therefore, it is recommended to pay attention to ensuring the regime for members of the Commune Military Command, especially for the Deputy Commander, and to consider and review the regulation "Deputy Commander is a commune-level civil servant" as for the position of Commander of the Commune Military Command" - voters of Quang Tri province expressed their opinions.
On October 2, according to Lao Dong reporter's investigation, regarding this content, the Ministry of National Defense sent a document responding to voters of Quang Tri province.
According to the Ministry of National Defence, Clause 1, Article 4 of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on the organization of force building and regimes and policies for militia and self-defense forces stipulates:
The number of Deputy Commanders of the Military Command in administrative units at the level of communes of type 1, border communes, coastal communes, and islands is arranged to not exceed 2 Deputy Commanders.
Based on the actual situation, the Provincial People's Committee shall submit to the People's Council of the same level for decision the number of Deputy Commanders of the Commune-level Military Command within the number of non-professional staff at the commune level prescribed in Point b, Clause 1, Article 6 and Clause 1, Article 33, Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government amending and supplementing a number of regulations on commune-level cadres, civil servants and non-professional staff at the commune level, in villages and residential groups; (specific regulations on the number of civil servants for each type: commune and town level: type I is 22 people; type II is 20 people; type III is 18 people, and non-professional staff at the commune level are prescribed: type I is 14 people; type II is 12 people; type III is 10 people)".
According to the Ministry of National Defence, the above regulation is consistent with the 2019 Law on Militia and Self-Defense Forces; Decree No. 33/2019/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.
If the regulation increases the number of "Deputy Commanders of Commune-level Military Commands, who are civil servants", it will increase the number of cadres and civil servants at the commune level, increase the budget, which will affect the guarantee of regimes and policies, not in accordance with the provisions of Clause 1, Article 6 of Decree No. 33/2019/ND-CP dated June 10, 2023 of the Government on the number of cadres and civil servants at the commune level.
The Ministry of National Defence also said that this agency is continuing to draft an adjustment to increase the level of benefits and policies for militia and self-defense forces according to the basic salary of 2,340,000 VND/month, to submit to the Government. After the Decree is announced and issued, the competent authorities will guide its implementation according to regulations.
