Accordingly, this draft Circular stipulates the leave regimes, the authority to resolve, register, manage, and suspend the leave regime for officers, professional soldiers in active service, defense workers, and defense officials in agencies, units, and organizations under the Ministry of National Defense.
This draft Circular applies to officers and professional soldiers in active service; defense workers, defense officials; relevant agencies, units, organizations and individuals.
Notably, the draft Circular also mentions the special leave regime as follows:
In addition to the annual leave, soldiers, workers and defense officials are entitled to special leave, not exceeding 10 days each time if the family encounters sudden difficulties caused by the husband or wife; biological children, legally adopted children; father, mother, legal guardian of the wife or husband who is seriously ill, has a risky accident, died, has passed away or has suffered heavy property damage due to natural disasters, fires, or dangerous epidemics.
Regarding the registration and management of leave:
When military personnel, workers and defense officials wish to resolve the leave regime, they must register with the personnel management agency about the time, time, reason and place of residence for synthesis, reporting to the competent authority for resolution and management according to regulations.
During the leave period, soldiers, workers and national defense officials are responsible for registering with the People's Committee of the facility where they are on leave.
Authority to resolve leave regimes:
Regiment commanders, regimental Political Commissars and equivalent or higher shall resolve for soldiers, workers and defense officials under their authority;
Officers holding positions from Regiment Commander, Political Commissar of the regiment and equivalent or higher are directly decided by the commander and political committee at the higher level.
The authority to handle retirement preparation leave prescribed in this Circular is implemented as follows:
For officers, the Regulations on personnel work in the Vietnam People's Army of the Central Military Commission are followed.
For professional soldiers, workers and defense officials, it is necessary to comply with the regulations of the Minister of National Defense.
Suspending leave:
When there is an order of encouragement, during wartime and in a state of national defense emergency, the Minister of National Defense shall issue an order to suspend the implementation of the leave regime; soldiers, workers and national defense officials who are performing the leave regime prescribed in this Circular must return to their units.
When a unit has an emergency task, in particular, any commander at any level with the authority to resolve the leave regimes prescribed in this Circular shall have the right to call soldiers, workers and defense officials to the unit to perform the task.
