The Ministry of National Defense is seeking opinions on a draft Circular on leave for officers, professional soldiers, workers and defense officials.
Accordingly, the Circular stipulates the leave regimes, the authority to resolve, register, manage, and suspend the leave regime for officers, professional soldiers in active service, defense workers, and defense officials in agencies, units, and organizations under the Ministry of National Defense.
This Circular applies to officers and professional soldiers in active service; defense workers, defense officials; relevant agencies, units, organizations and individuals.
Soldiers, workers and defense officials are entitled to the following leave: Daily leave outside of working hours; Weekly leave; Annual leave; Special leave; Holidays and Tet; Nursing leave; Retirement leave.
Notably, Article 10 of the draft Circular refers to the content of military personnel, workers and defense officials who are entitled to pre-retirement leave as follows:
Soldiers, workers and defense officials who have decided to retire or are entitled to pre-retirement leave, if they have worked until the time of pre-retirement leave:
From 15 years of service to less than 20 years of leave with 6 months off;
From 20 years of service to less than 25 years of service, 9 months off;
After 25 years of service or more, 12 months off will be granted.
The retirement preparation period according to regulations, soldiers, workers and national defense officials are paid and counted as social insurance participation period.
Soldiers, workers and defense officials who wish to retire immediately (not retiring in preparation for retirement or not retiring for enough time as prescribed), when transferred, will receive a salary difference due to not retiring in preparation for retirement according to current regulations; except for those who are entitled to one-time allowance due to early retirement according to prescribed age.
During the retirement preparation period, if you are detected with serious illnesses, diseases requiring long-term treatment, or mental illness, follow the provisions of Circular No. 157/2013/TT-BQP dated August 26, 2013 of the Minister of National Defense regulating the management, treatment, care, and settlement of policies for soldiers, workers, defense officials, and people working in key organizations managed by the Army who are suffering from serious illnesses, diseases requiring long-term treatment, mental illnesses and guiding documents for implementation.
