The National Assembly has passed the Law on Mutual Legal Assistance in Civil Matters. This Law takes effect from July 1, 2026.
This Law stipulates the principles, authority, order, and procedures for implementing judicial assistance in civil matters between Vietnam and foreign countries; responsibilities of Vietnamese state agencies in judicial assistance in civil matters.
The Law on Mutual Legal Assistance in Civil Matters clearly stipulates the cost of implementing requests for mutual legal assistance in civil matters.
Accordingly, the cost of implementing a request for mutual legal assistance in civil matters is the amount of money paid for the implementation of mutual legal assistance in civil matters. Vietnam and foreign countries can agree on the cost of implementing a request for mutual legal assistance in civil matters when signing international treaties.
The cost of implementing requests for mutual legal aid in civil matters is implemented in accordance with the provisions of international treaties to which the Socialist Republic of Vietnam is a member.
In cases where Vietnam and foreign countries are not members of international treaties or international treaties to which the Socialist Republic of Vietnam is a non-regulating member, the cost of implementing judicial assistance on civil matters includes fees and charges according to the provisions of law on fees and charges and actual costs.
The cost of implementing judicial assistance in civil matters is paid by the person who is obliged to pay from the requested country, except for the cost of public postal services to deliver foreign documents specified in this Law.
The level of collection, exemption, reduction, payment, management, and use of fees and charges shall be implemented according to the provisions of law on fees and charges.
The Law also stipulates funding for state management of judicial assistance in civil matters, public postal service costs for delivering foreign documents and costs for implementing judicial assistance in civil matters in cases where state agencies are people who are obliged to pay by the state budget under the provisions of the law on state budget and other relevant legal regulations.
