Clause 2, Clause 3, Article 1 of Decree No. 143/2013/ND-CP stipulating scholarship refunds and training costs (“Decree No. 143/2013/ND-CP”) supplemented by Article 1 of Decree No. 51/2026/ND-CP (effective from March 26, 2026) stipulates the scope of regulation and subjects of application as follows:
2. This Decree applies to:
a) Students who are sent abroad to study by competent state agencies using state budget funds (including education programs under the Agreement signed with the State of Vietnam);
b) Learners are allowed to participate in domestic training programs using state budget funds or according to training order projects approved by the Prime Minister using state budget funds;
c) Agencies, organizations, and individuals related to the implementation of training cost reimbursement.
3. This Decree does not apply to learners who are cadres, civil servants, public employees and learners under the enrollment system.
Clause 1, Article 7a of Decree No. 143/2013/ND-CP, supplemented by Article 3 of Decree No. 51/2026/ND-CP (effective from March 26, 2026), stipulates the elimination and exemption of scholarships and training costs as follows:
1. Cases where learners are erased or exempted from reimbursement costs:
a) Removing reimbursement costs in cases where the learner has died or is declared dead by the Court according to the provisions of law;
b) Exemption from compensation costs in one of the following cases:
The learner is certified by a competent medical facility as not healthy enough to work;
Students who have not fulfilled their working obligations for a sufficient period as prescribed but are subsequently decided by competent authorities to be transferred, rotated, assigned or transferred to another position;
Students due to objective and force majeure reasons cannot comply with the working arrangement of a competent state agency. The competent state agency decides on compensation and considers and decides on the exemption of compensation costs for this case.
Thus, from March 26, 2026, learners may be eliminated or exempted from scholarships and training costs from the State budget if they fall into one of the above cases.
