Mr. Vu Hoang Dang (Thanh Hoa) said that according to Mr. Dang's research, Clause 5, Article 6 of Circular 02/2021/TT-BNV of the Ministry of Home Affairs stipulates the requirements for civil servants taking the exam to be promoted to the rank of senior specialist: Having held the rank of specialist or equivalent for at least 9 years (excluding probationary and probationary periods).
In case of a period equivalent to the specialist rank, the minimum period of holding the specialist rank is 1 year (full 12 months) calculated from the deadline for submitting application for promotion exam.
"So, I would like to ask which document is the method of calculating the equivalent of a specialist rank? I am a police officer who has transferred to another profession, am I considered equivalent to a specialist?" - Mr. Dang wondered.
Regarding the reflection and recommendation of Mr. Vu Hoang Dang, the Ministry of Home Affairs has a response.
According to the provisions of Point d, Clause 3, Article 30 of Decree No. 138/2020/ND-CP, in case a civil servant, before being recruited or accepted, has worked for a period of time with compulsory social insurance payment in accordance with the provisions of the Law on Social Insurance, working in a position with appropriate professional qualifications (if the working period is not continuous and has not received a one-time social insurance subsidy, it will be accumulated) and that period is calculated by the competent authority as the basis for salary classification in the current civil servant rank, it will be considered equivalent to the current civil servant rank.
Accordingly, if your previous working time in the People's Public Security force is calculated by the competent authority as the basis for salary classification in the current civil servant rank, it will be counted as the time in the equivalent rank to take the exam to be promoted to the next higher civil servant rank.
