On the morning of October 10, Chairman of the National Assembly's Economic Committee Vu Hong Thanh reported on the examination of the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
Chairman Vu Hong Thanh raised some notable points about amending and supplementing a number of articles of the Law on Bidding.
Regarding bidding, the Standing Committee of the Economic Committee believes that the regulation that if a project or foreign loan agreement is not signed or approved, the investor can cancel the bid and not have to reimburse the bidder for the bidding costs may cause disadvantages, affect the interests of the bidders and affect the ability to attract reputable bidders in the future.
The provision allowing the signing of a contract before the signing of a foreign loan agreement may lead to risks if the negotiation process with the sponsor is prolonged or fails.
Mr. Vu Hong Thanh requested the Government to explain and assess the specific impacts of applying these regulations and handling directions in the draft law.
Regarding the regulations on purchasing drugs for retail sale at public hospital pharmacies, the Standing Committee of the Economic Committee believes that it is necessary to remove difficulties, improve the legal system on bidding in the health sector, ensure the supply of drugs and medical supplies for medical examination and treatment, and facilitate patients in purchasing quality-assured drugs at public health facilities.
However, the Government is requested to explain and clarify the inspection and supervision mechanism to ensure publicity, transparency and economic efficiency when proposing to apply direct purchasing many times and needs specific opinions from the Ministry of Health on this content.
"There are opinions that, in actual implementation, the Ministry of Health believes that there are no problems with bidding, amending this regulation is only convenient for management leaders, but is harmful to patients and basically does not meet the bidding goals; therefore, it is recommended not to amend this regulation," said Mr. Vu Hong Thanh.
Commenting on this content, Vice Chairman of the National Assembly Nguyen Khac Dinh suggested a thorough review to remove the current problems, many of which are in the overall picture, opening up new, more convenient, better, and more effective things for people and businesses.
"Do not open up anything that makes state management tighter but more difficult for people and businesses like the drug bidding that the Economic Committee mentioned. The review agency said it is only good for state management agencies but in reality people and businesses do not benefit," the Vice Chairman of the National Assembly cited.
The Vice Chairman of the National Assembly clearly stated that whatever the Government presents, we will consider it, and if we find something that is not acceptable, we will eliminate it. If necessary, we will study it in the next session, and fix any problems that arise, urgently but not perfectionist.
The Vice Chairman of the National Assembly said that the revised content must be practical and feasible, otherwise it will be even more difficult to revise it without being able to handle it.
Regarding the regulations on purchasing drugs for retail sale at public hospital pharmacies, Vice Chairwoman of the National Assembly Nguyen Thi Thanh agreed with the viewpoint of the Economic Committee. In which she requested the Government to explain and clarify the inspection and supervision mechanism for multiple direct purchases.
