On June 12, the People's Council (HĐND) of Hanoi City, XVII term, 2026-2031, opened the fourth session (specialized session) to consider important contents under its authority; including many contents to implement the Capital Law in 2026.
At the group discussion session, delegate Do Thi Lan Huong - Secretary of the Party Committee, Chairman of the People's Council of Tung Thien ward said that it is necessary to continue to clarify some contents related to other support policies to remove difficulties for grassroots levels in the implementation process.
According to the delegate, site clearance work is always a very difficult area at the grassroots level. For large projects, the implementation time is often extended for many years. In that process, the system of legal policies, the provisions of the Land Law and guiding decrees have many changes, leading to the application of compensation and support policies for people not being truly synchronized.
It is the lack of policy synchronization between stages that has led to the emergence of people's complaints, affecting the progress of project implementation," delegate Do Thi Lan Huong emphasized.
Citing the reality from 1 project passing through the area formerly belonging to Son Tay town and Ba Vi district (old), now belonging to new administrative units such as Son Tay ward and Suoi Hai commune, the delegate said that the project has been implemented since 2022 and has been prolonged for many years.
At the time of project implementation, other support policies for compensation and site clearance are applied according to the provisions of the 2013 Land Law and the provisions of Hanoi City. At that time, households are entitled to other support levels for garden land, crops, and assets on land with support levels of 80%, 50% or 10% depending on each specific case.
However, after the 2024 Land Law took effect, other support policies changed. In one period, people were no longer applied this support amount. After that, new regulations again assigned the authority to decide on other support levels to the commune level.
According to delegate Do Thi Lan Huong, to remove difficulties for the project and ensure the rights of the people, the locality has proactively reported, asked for opinions from departments and branches and agreed to apply support levels according to previous policies to ensure synchronization between households in the same project.
In the same project, if some households are entitled to support and some are not, there will definitely be comparisons and prolonged mass complaints, causing many difficulties for the implementation process" - the delegate expressed his opinion.
The delegate said that after Decree No. 151 of the Government assigned authority to the commune level, the locality has organized meetings of the Standing Committee, People's Committee and professional departments to agree on applying the support level according to the city's previous regulations to ensure synchronization in policies.
However, after completing the dossier and deploying site clearance work, there are new regulations to replace and transfer the decision-making authority to the provincial level. The locality has sent documents requesting opinions from departments and branches but has not been approved, leading to the current situation that there are still cases where households in the same project are applied different support policies.
This is a very difficult issue for grassroots levels in the process of mobilizing people and deploying site clearance" - the delegate shared. In addition, delegate Do Thi Lan Huong also reflected obstacles related to land areas originating from previous agricultural and forestry farms.
According to the delegate, there are currently many land areas in the commune contracted by agricultural and forestry farms or production centers to households for use. When the State recovers land to implement projects, the determination of subjects, support levels and jurisdiction to resolve these cases still has many inadequacies.
The delegate proposed that the city soon study a plan to hand over land funds originating from agricultural and forestry farms to local management; and at the same time continue to review and improve mechanisms and policies to ensure synchronization in compensation, support and site clearance.
Answering the issue related to other support levels mentioned by delegates, Chairman of Hanoi People's Committee Vu Dai Thang said that this situation had previously occurred. However, in the past 6 months, the city has researched new mechanisms to have a unified document in policy synchronization. When a commune or ward has a policy that has been approved by the city, it is immediately applied to the remaining units (with the same project).

Regarding the issue of agricultural and forestry land, farms, Chairman of Hanoi People's Committee Vu Dai Thang said that ministries and branches have not yet handed over, so the city does not have a basis to hand over to communes and wards.
Mr. Thang affirmed that when ministries and sectors hand over to the city, the city will definitely hand over to communes and wards.
