One is ban, two is management
Contributing opinions to the draft Law on Teachers, delegate Do Huy Khanh (Dong Nai Delegation) agreed with the contents proposed in the draft law to improve the quality of education.
At Point c, Clause 2, Article 11, the prohibited act is forcing students to participate in extra classes in many forms. According to the delegate, the Ministry of Education and Training needs to coordinate with agencies to issue specific regulations as well as management mechanisms for this issue. Because, in fact, extra classes are a necessary need of society. However, there are two streams of public opinion: One is prohibition, the other is management. Therefore, the draft law needs to have a management mechanism for extra teaching and learning.
Commenting on the draft Law on Teachers, delegate Chamalea Thi Thuy (Ninh Thuan Delegation) said that the regulation that students cannot be forced to take extra classes in any form is necessary. However, this content has also been stipulated in Clause 5, Article 22 of the Law on Education. That is, forcing students to take extra classes for money is prohibited.
Delegate Chamalea Thi Thuy said that it is necessary to thoroughly consider the issue of extra teaching and learning in order to make specific and appropriate regulations.
Regarding the regime and policies for teachers, delegates agreed with the principle that "education must be considered a national policy" in every stage of the country's development. Therefore, attention must be paid to the regime and policies and to honoring the team working in education.
However, according to the delegate, in order to implement the regime and policies set out in the draft law and the draft Decree stipulating 9 contents of salary and allowance policies to support and attract teachers, it is necessary to base on the Budget Law to ensure implementation or not, and to have a thorough assessment of policy impact.
Requiring weaker groups to take extra classes is necessary.
Delegate Nguyen Van Canh (Binh Dinh Delegation) said that although the curriculum and teachers are the same, the students' learning levels are different. The academic performance in a class can be divided into three groups. The group that meets the standards is usually 80%, the group that excels is 9-10%, and the group that cannot keep up with their friends is 10%.
“It is necessary to require the weaker group to take extra classes to catch up with their peers,” said the delegate.
The delegate agreed that tutoring with the purpose of “getting a higher score than the actual ability”, because tutors are not objective, should be stopped. He proposed that the education sector build a question bank for each topic in each subject. Any educational institution that allows teachers to tutor their own students must have the test taken randomly from the question bank. This will help avoid negative situations, discrimination against students who do not take extra classes and reflect the true ability of the students.
The policy is not to prohibit private tutoring.
Regarding the issue of extra teaching and learning raised by some delegates, Minister of Education and Training Nguyen Kim Son said that the policy is not to prohibit extra teaching but to prohibit unethical acts in extra teaching, including "teachers forcing students to take extra classes".
Regarding some opinions on teachers' salary scales, the Minister said that when developing, the ministry must also look at other sectors, not wanting its sector to have "unusual" privileges, benefits or favors.
Emphasizing the need to absorb as many opinions as possible, including 90 opinions discussed in groups and 36 opinions discussed in the hall of the 8th Session of the 15th National Assembly, the Minister affirmed that the draft Law on Teachers was developed partly because of the difficulties of teachers, but the main reason for developing and promulgating the Law is to develop the teaching staff.
