On January 16, according to Lao Dong reporter's investigation, the Ministry of Home Affairs submitted a report on the draft Law on Government Organization (amended) to the Ministry of Justice for review.
One of the new points of the draft Law is to separate the content related to the duties and powers of Ministers and Heads of ministerial-level agencies as members of the Government into a separate article in a separate chapter, not together with the provisions on ministries and ministerial-level agencies as in the current law.
The report of the Ministry of Home Affairs clearly stated that this is to clearly define the tasks and powers of Ministers and Heads of ministerial-level agencies as members of the Government and the Government collective in participating in solving the Government's tasks (being personally responsible to the Prime Minister, the Government, and the National Assembly for the sectors and fields assigned to them for management; explaining and answering questions from National Assembly Deputies).
This is to ensure separation from the responsibilities of the Minister and Head of a ministerial-level agency as the head of the ministry (personally responsible to the Prime Minister and the Government for the results and effectiveness of the operations of the ministry and ministerial-level agency; for decisions and the results of implementing their decisions within the scope of assigned tasks and powers).
The Draft Law on Government Organization (amended) has stated the duties and powers of Ministers and Heads of ministerial-level agencies as members of the Government in Article 15.
Accordingly, Ministers and Heads of ministerial-level agencies are members of the Government and perform the following specific duties and powers:
Attend Government meetings and participate in resolving common tasks of the Government; participate in voting at Government meetings, and together with the Government decide on issues under the Government's authority.
Propose to the Government and the Prime Minister necessary policies, mechanisms, and legal documents under the authority of the Government and the Prime Minister; proactively work with the Prime Minister and Deputy Prime Ministers on the work of the Government and other related work; be responsible for the entire content and progress of submitting assigned projects, proposals, and legal documents.
Carry out specific tasks according to the sector or field assigned by the Government or authorized by the Prime Minister. Direct, guide, and inspect the implementation of laws, strategies, plans, programs, and decisions of the Government and the Prime Minister on the assigned sector or field.
Perform other tasks assigned by the Prime Minister.
Article 16 of the draft Law states the responsibilities of other members of the Government.
That is: Be personally responsible to the Prime Minister, the Government and the National Assembly for the assigned sectors and fields of management; together with other members of the Government, be collectively responsible for the activities of the Government.
Report on work to the Government, Prime Minister and report to the People on important issues under management responsibility; explain and answer questions from National Assembly Deputies.
