New proposal on the responsibility of the Department Director

The Ministry of Home Affairs has made new proposals on the working regime of the Department and the responsibilities of the Department Director.

The draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the organization of specialized agencies under the People's Committees of districts, towns and cities under provinces and centrally run cities has been sent by the Ministry of Home Affairs to the Ministry of Justice for appraisal.

In the Draft Decree, the Ministry of Home Affairs proposed to regulate the working regime of the Department and the responsibilities of the Department Director.

Accordingly, the Department under the Provincial People's Committee operates under the head regime and the Working Regulations of the Provincial People's Committee, ensuring the principle of democratic centralism.

Pursuant to the provisions of law and the assignment of the Provincial People's Committee, the Director of the Department shall issue the Department's Working Regulations and direct and inspect their implementation.

The Director of the Department is responsible to the People's Committee and the Chairman of the People's Committee at the provincial level for performing the functions, tasks and powers of state management of the sector and field in the locality and the work assigned or authorized by the People's Committee and the Chairman of the People's Committee at the provincial level; he/she shall not transfer work within his/her duties and powers to the People's Committee and the Chairman of the People's Committee at the provincial level.

For issues beyond his/her authority or within his/her authority but lacking the capacity and conditions to resolve, the Department Director must proactively work with the relevant Department Director to complete the dossier to submit to the People's Committee and the Chairman of the Provincial People's Committee for consideration and decision; practice thrift, combat waste and take responsibility for corruption and damage occurring in organizations and units under his/her management.

The Director of the Department is responsible for reporting to the People's Committee, Chairman of the People's Committee of the province; Ministries, and ministerial-level agencies on the organization and operation of his/her agency; reporting on work to the People's Council of the province when requested; providing necessary documents upon request of the People's Council of the province; responding to voters' recommendations and questions from the People's Council Delegates of the province on issues within the scope of the sector and management field; coordinating with other Department Directors, heads of socio-political organizations, and relevant agencies in performing the tasks of the Department.

Appoint, transfer, rotate, reward, discipline, dismiss, resign, implement regimes and policies for Heads and Deputy Heads of affiliated and subordinate agencies and units according to regulations and decentralization of local cadre management.
