Deputy Minister of Home Affairs Truong Hai Long has just signed the draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the organization of specialized agencies under the People's Committees of districts, towns and cities under provinces and centrally run cities, and sent it to the Ministry of Justice for appraisal.
In the draft, the Ministry of Home Affairs proposed to have 16 departments, of which 6 departments will remain stable in terms of name, functions and tasks; 5 departments will be formed after the merger corresponding to the arrangement of ministries at the Central level; 5 departments will receive and add functions.
The departments are organized in a unified manner, including: Department of Home Affairs; Department of Justice; Department of Finance; Department of Construction; Department of Agriculture and Environment; Department of Science and Technology; Department of Health; Department of Education and Training; Department of Industry and Trade; Department of Culture, Sports and Tourism; Inspectorate; Office of the People's Committee.
Of which, 5 departments were formed from the merger of 10 departments and branches corresponding to the arrangement of ministries at the Central level; 4 departments were kept intact and received and supplemented with functions and tasks.
For Hanoi and Ho Chi Minh City, 15 departments are organized (not including the number of departments increased according to the provisions of the Capital Law and the pilot departments).
Hanoi and Ho Chi Minh City are allowed to decide on the establishment, separation, merger and consolidation of departments, ensuring that they are suitable to the characteristics of the city and do not exceed the number of departments as prescribed.
For other provinces and cities, based on local state management requirements for sectors and fields, organize and arrange specialized agencies, ensuring no more than 13 departments; for type 1 provinces with specific fields, no more than 14 departments are specified in this Decree.
On average, each department has 3 Deputy Directors. However, the Ministry of Home Affairs proposed allowing the second-class provinces to add or increase by no more than 7 Deputy Directors; the first-class provinces to add no more than 10 Deputy Directors; Hanoi and Ho Chi Minh City to add no more than 15 Deputy Directors.
The Provincial People's Committee shall decide on the specific number of Deputy Directors of each department, based on the number of departments established, the scope, functions and tasks of the department.
Regarding the number of deputy heads of organizations under the department, the Ministry of Home Affairs added regulations on departments under the department for Hanoi and Ho Chi Minh City; from 20 civil servant positions or more, no more than 4 deputy heads of departments can be arranged (this regulation does not apply to department offices).
This regulation has received comments and created conditions for the implementation of state management advisory work on sectors and fields in the two largest cities of the country.
