Article 7 of the Draft Circular on policies and regimes when arranging and streamlining the organization of the Army clearly states the regimes and subsidies when streamlining the payroll and restructuring.

On March 31, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense is soliciting opinions on the 2nd Draft of the Circular on policies and regimes when reorganizing and streamlining the apparatus in the Army.

In Article 7, the Ministry of National Defense proposes that cases working at agencies and units not directly affected by the organizational arrangement but must streamline the payroll, restructure, and improve the quality of the team to enjoy the policy of subsidies for the number of years of early retirement, subsidies according to the working period with compulsory social insurance (SI) and a one-time pension subsidy for the number of months of early retirement.

In cases where staff streamlining and restructuring are required:

Cases of work in agencies and units that are not directly affected by the reorganization of the apparatus but must streamline the payroll, restructure, and improve the quality of the team include:

Subjects specified in Clauses 1, 2, 3, 4 and 5, Article 2 of this Circular who have at least 5 years left until the highest service age or have reached the retirement age according to the instructions in Point a, Point b, Clause 5, Article 5 of this Circular, and are competent authorities to resolve early retirement due to the need to streamline the payroll, restructure, and improve the quality of the team will enjoy the policies and regimes specified in Clause 7, Article 1 of Decree No. 67/2025/ND-CP.

The regimes include early retirement age allowance and allowance according to working time with compulsory social insurance contributions.

The subsidy regime for the number of years of early retirement and the subsidy regime according to the working period with compulsory social insurance contributions shall be implemented according to the instructions in Point b, Point c, Clause 1 and Clause 3, Article 6 of this Circular.

Applications and benefits for working time with compulsory social insurance contributions are calculated as follows:

Receive a subsidy of 5 months of current salary for the first 20 years of work with compulsory social insurance contributions. From the 21st year onwards, for each year of work with compulsory social insurance contributions, a subsidy of 0.5 months of current salary will be granted.

In case of having paid compulsory social insurance for 15 years or more and being eligible for pension according to the provisions of the law on social insurance at the time of early retirement, they will receive a subsidy of 4 months of current salary for the first 15 years of work; from the 16th year onwards, for each year of work with compulsory social insurance payment, they will receive a subsidy of 0.5 months of current salary.

The draft Circular on policies and regimes when arranging and streamlining the organizational apparatus in the Army has 18 articles, an increase of 6 articles compared to the previous draft circular;

Accordingly, the draft Circular expands the scope of application to guide the implementation of policies and regimes for subjects under the management of the Ministry of National Defense in implementing the organizational arrangement; streamlining the payroll, restructuring, improving the quality of the team; cadres who are not old enough to be re-elected, reappointed or meet the requirements for re-election and reappointment; cadres participating in Party committees in Party committees must end their activities according to the provisions of Articles 7, 8, 9, 10, 11 and 14 of Decree No. 178/2024/ND-CP, Clauses 5, 6, 7, 8, 9, 10 and 11, Article 1 of Decree No. 67/2025/ND-CP.
